HomeMy WebLinkAbout99-177 99Cm2854~ ~,K 3301 F'£~ OFFICIAL RECORDS OF MOHAVE COUHTY~ AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 05/12/1999 02:51P PA~E 1 OF 2 HOHAVE COUNTY BOARD OF SUF'ERVISORS RECOROING FEE RESOLUTION NO. 99-177 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 30, LAKE MOHAVE COMMERCIAL CENTER, IN THE NE¼ NE¼ OF SECTION 2, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR A PROPANE SALES TANK IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAYE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by A. George and Jeanette Dennis of Kingman, Arizona, and WHEREAS, this property is located east of U.S. Highway 93, on the northwest side of Pierce Ferry Road in the Outlying Community of Dolan Springs. The site is accessed from U.S. Highway 93 via northwest approximately five and three-quarter (5¼) miles to the site, located on the northwest side of Pierce Ferry Road at Lloyd Street. The property is vacant and relatively flat, sloping slightly to the southwest. The surrounding land uses consist of other general commercial businesses on both sides of Pierce Ferry Road in Dolan Springs, the Post Office on the south side and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Pemfit for a propane sales tank in a C-2 (General Commercial) zone. The Mohave County General Plan designates this area as a Rural Development Area and Dolan Springs is an Outlying Community, and WItEREAS, a review of FEMA FIRM Panel #040058-1800C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on April 14, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 99-177 Page 2 1. Tiffs Zoning Use Permit is for a propane sales tank in a C-2 (General Commercial) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not cmrm~enced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 10, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
