A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 98-214
SETTING FORTH A REZONE OF THE SOUTH 635 FEET OF THE EAST WES~T 342.9 FEET OF
THE SW¼ SW¼ SW¼ OF SECTION 20, TOWNSHIP 23 NORTH, RANGE 13 WEST, FROM A
(GENERAL) ZONE TO M (GENERAL MANUFACTURING) ZONE, IN THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10,
1999, a public heating was conducted to determine whether an Amendment to BOS Resolution No. 98-214,
setting forth a Rezone, should be granted for the above-described property as requested by the Mohave
County Planning and Zoning Department to correct a scrivener error in the legal description. The property
owner of record is the Claude K. Neal Family Trust, being represented by B. Marc Neal, Co-Trustee, of
Kingman, Arizona, and
WHEREAS, the language to be added has been bolded and double underlined. Language to be
deleted has been strdck, and
WHEREAS, this property is located south of State Highway 66 (Old US Highway 66) and west of
Hackberry Road. The site is accessed from State Highway 66 via south on Hackberry Road approximately
one-half (0.5) mile to a roadway easement known as Neal Easement, then west on Neal Easement to the site,
located approximately one-quarter riffle west of Hackberry Road. The property has a 50 foot x 120 foot steel
building under construction, with a permit, on it. The terrain is gendy rolling hills, generally sloping to the
northeast. The surrounding land uses consist of vacant land, open range land and a few scattered single-
family residences. There are no significant drainage patterns, and
WHEREAS, this amendment is to correct a scrivener error in the legal description changing
the South 635 feet of the East 342.9 feet to the South 635 feet of the West 329.9 feet and to delete the
requirement for a Specific Use Permit as it is no longer required in the M (General Manufacturing)
zone, and
WHEREAS, the applicants request this Amendment to BOS Resolution No. 98-214, approving a
Rezone, to allow a water bottling plant. The applicant proposes to rezone a five-acre portion of the 45.1-acre
parcel to M (General Manufacturing). T~ae Mohave County General Plan designates this area as a Rural
Development Area, and

WHEREAS, a review of FEMA FIRM Panel #040058-2200B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 14, 1999, the Commission recommended APPROVAL of the Amendment to BOS Resolution No. 98-
214 setting forth a Rezone subject to the following:

2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. The rezone shall not become effective until at least 30 days after final approval of the chmnge
in classification by the Board of Supervisors, as per ARS 11-829E.
5. If these conditions are not met within two years this approval will be void. If at the
expiration of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 10, 1999, APPROVED this Amendment to BOS Resolution No. 98-214 setting forth a
Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
