A RESOLUTION SETTING FORTH A REZONE OF LOTS 13 AND 14, BLOCK Y, LAKE
MOHAVE COUNTRY CLUB ESTATES, UNIT 3, AMENDED, IN SECTION 31, TOWNSHIP 22
NORTH, RANGE 16 WEST, FROM R-M/lA (MULTIPLE-RESIDENTIAL/ONE ACRE MINIMUM
LOT SIZE) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN
THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10,
1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above~
described property as requested by David E. Hollingsworth, agent for Joe W. Ott of Kingman, Arizona, and
WHEREAS, this property is located north of the City of Kingman and east of Stockton Hill Road,
between Gordon Drive and Northern Avenue. The site is accessed from Kingman via north on Stockton Hill
Road to Gordon Drive, then east on Gordon Drive to the site, located on the north side of Gordon Drive
between North Skylark Road arid North Bond Street. The property is vacant and relatively flat, sloping
slightly to the southeast. The surrounding land uses consist of vacant lots, several churches, a fire station,
and several other general commercial businesses. There are single-family residences to the north. There
are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow an owner-occupied construction office
and yard. The Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended but the use is not consistent with the surrounding
land uses and terrain, as the nearest commercial zoning is over one (1) mile to the east of this
location and approximately one-half (½) mile to the west in the City of Kingman.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
VqItEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 14, 1999, the Commission recommended APPROVAL for a Rezone subject to the following:

1. This property will be rezoned C-2H (General Commercial Highway Frontage).
2. The applicant will provide a view-obscuring fence, a six-foot (6'-0") block wall, between the
commercial area and the residential property to the north.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establistfing the use. Ingress and egress to this site will be
at the satisfaction of the Mohave County Public Works Engineer.
4. Seventeen feet shall be dedicated adjacent to the north side of Gordon Drive, complete with
20-foot radius curves at all roadway right-of-way intersections, via a separate instrument, as
unencumbered, first position roadway right-of-way, to Mohave County on behalf of the
public. A title report, to confirm unencumbered first position roadway right-of-
way/easement, will be provided by the applicant to Mohave County Public Works
Department.
5. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
6. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
7. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the mzoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 10, 1999, DENIED this Rezone as the Rezone did not receive the unanimous vote of all
Board as required under A.R.S. 11-829.C.
