HomeMy WebLinkAbout99-186 MOHAVE COUNTY BOARD OF SUPERVISORS RESOLUTION NO. 186 WHEREAS, Arizona Revised Statutes A.R.S. § 11-251 (45) grants that the Mohave County Board of Supervisors ("Board") may purchase real property for public purposes, provided that £mal payment shall be made not later than five years after the date of parchase; and WHEREAS, Mohave County has the opportunity to purchase 160 acres of land directly adjacent to and north of Mohave County's Cerbat Landfill facility from Equatorial Mineral Park, Inc. ("Equatorial"), the land being more particularly described as the Northwest 1/4 of Section 35, Township 23 North, Range 18 West, Gila &Salt River Meridian, Motmve County, Arizona ("Property"); and WHEREAS, a report, dated April 27, 1999, regarding the purchase of the Property was provided to the Board by the Mohave County Public Works Department; and WHEREAS, a appraisal report by Woods Appraisal Service, dated April 9, 1998, which established the value of the Property at $65,000, was submitted by Equatorial to Mohave County Public Works for review, and WHEREAS, Mohave County Public Works commissioned Tomlin Appraisal Company to review the appmisai prepared by Woods Appraisal Service; and WHEREAS, in their review dated June 10, 1998, Tomlin Appraisal Company concurred with · the Property value stated in the appraisal prepared by Woods Appraisal Service; and WHEREAS, on August 10, 1998, the Mohave County Board of Supervisors entered into a License Agreement with Equatotlai Mineral Park, Inc., to allow Mohave County to conduct certain investigations to determine the desirability of the Property; and WHEREAS, an ALTA survey for the Property was completed for and received by Mohave County Public Works from Rand Wallace Holmquist, R.L.S., of R.W. Holmquist & Associates on December 16, 1998; and WHEREAS, in January 8, 1999, SECOR International, Inc., an Engineering Finn under contract with Mohave County, conducted a feasibility geotechnical investigation of the Property for landfill development and found that the Property appeared to be suited for landfill development; and WHEREAS, the board considered the advantages stated in the Public Works report dated April 29, 1999, and WHEREAS, the negotiated purchase price between Molmve County Public Works and Equatorial Mineral Park, Inc., is $55,000.00 which is less than the Appraised Value of the Property; and Page WIIEREAS, the purchase of the Property will be funded from monies already collected from Landfill User Fees, and no General Fund monies will be used. NOW, THEREFORE, BE IT RESOLVED, that the Board, as of this date, does approve the purchase of the Northwest 1/4 of Section 35, Township 23 North, Range 18 West, Gila &Salt River Meridian, Mohave County, Arizona, from Equatorial Mineral Park, Inc., in the Amount of $55,000 and other good and valuable consideration, subject to the Real Estate Purchase Contract and Escrow Instructions, Release and Covenant Agreement, and acceptance of the Special Warranty Deed.
