HomeMy WebLinkAbout99-192 iNDEXED JOAN M(: CALLy '10HAVE COUNTY ~E(:O~DER 07/'~8/t9f)? 01:35P PAGE t OF 2 RECORDING FEE 0.00 RESOLUTION NO. 99-192 A RESOLUTION SETTING FORTH AN AMENDMENT TO THE VIRGIN RIVER COMMUNITIES AREA PLAN LAND USE DESIGNATION MAP TO ASSIGN A LAND USE DESIGNATION FOR THE SOUTH 350 FEET OF THE SE¼ SE¼ OF SECTION 10, EXCLUDING THE SOUTH 50 FEET, IN TOWNSHIP 39 NORTH, RANGE 16 WEST, FROM NO DESIGNATION TO COMMERCIAL (COM) DESIGNATION, IN THE SCENIC/ARVADA PORTION OF THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on July 26, 1999, a public hearing was conducted to determine ~vhether an Amendment to theVirgin River Communities Area Plan Land Use Designation Map should be approved by changing the current land use designation from no designation to Conunercial (COM) for the above-referenced property, as requested by Ralph Waters of Mesquite, Nevada, and WHEREAS, this property is located north of Elbow Canyon Road between Littlefield Drive and Cottontail Road. The site is accessed from Mesquite, Nevada via east on Elbow Canyon Road to Zion Park Way, then north on Zion Park Way to where it becomes Cottontail Road, to the property located on the southwest comer of Las Vegas Way and Cottontail Road. The property is vacant and is located on gently rolling hills that slope to the northxvest toward the Virgin River. The surrounding land uses consist of vacant land and a few widely scattered single-family residences. There are no significant drainage patterns, and WHEREAS, the Virgin River Communities Area Plan, adopted in May-, 1998, consists of approximately 25 square miles and five outlying communities. The property to be designated is located in the Scenic/Arvada community area in a Suburban Development Area of both the General and Area Plans, and consists of approximately 9.1 acres, and WHEREAS, the applicant requests the Commercial (COM) land use designation to allow for future commercial uses to meet community or regional needs within the Scenic Improvement District, and WHEREAS, a review of FEMA FIRM Panel maps 040058-0200B indicates the described parcel is in Zone A, in a Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are relevant to the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. PAGE 2 OF 2 BK 3348 PG 268 FEE~99045547 RESOLUTION NO. 99-192 Page 2 c. The site is adequate for the action intended and the proposed land use adjoins the same land use designation to the east. The action is consistent with the intent of the Virgin River Commmfities Area Plan, whereby undesignated parcels at the time of Area Plan approval would be assigned a land use designation in the future consistent with the intent of the Area Plan and the land uses proposed therein, as previously agreed to by the Virgin River Communities Area Plan Committee zu~d at a public hearing for approval by the conununities. d. The neighboring area contains other like land use designations equal to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard area, and WHEREAS, at a public hearing on May 12, 1999, the Mohave County Planning and Zoning Commission recommended APPROVAL for this action subject to the following: 1. The Virgin River Communities Area Plan Land Use Designation Map, and Map A-1 of the Area Plan, will be modified to designate the proposed change from no designation to Commercial (COM). WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 7, 1999, and posted on July 9, 1999, as required by Arizona Revised Statutes. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, July 26, 1999, APPROVED this Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
