HomeMy WebLinkAbout99-195 INDEXED '~~ '9'90.~54~' BK 3348 F'G 272 OFFICIAL RECORDS OF MOHRVE COUNTY JO~N MC CALL~ MOH6VE COUNTY RECORDER 07/28/~999 O~J35P P~GE ~ OF 2 MOH~YE COUNTY BO~RB OK SUPERVISORS ~, RECORDinG FEE RESOLUTION NO. 99-195 A RESOLUTION SETTING FORTH AN AMENDMENT OF THE MOHAVE VALLEY SOUTH AREA PLAN, AKA SOUTH MOHAVE VALLEY AREA PLAN, AS AMENDED, ORIGINALLY ADOPTED JANUARY 7, 1980, TO PROVIDE FOR A CHANGE IN THE LAND USE DESIGNATION OF A PORTION OF SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST FROM RE (RESIDENTIAL RECREATION) TO SFR (SINGLE FAMILY RESIDENTIAL), IN THE SOUTH MOHAVE VALLEY, MOHAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on July 26, 1999, a public hearing was conducted to determine whether approval should be granted to amend the Mohave Valley South Area Plan, designating the above-described property as a Single-Family Residential (SFR) area as requested by Kathleen Tackett-Hicks, Kingman, Arizona, representing the property owners James A. and Pamela Cmnpbell and Michael Lloyd Gallagher of Mohave Valley, Arizona, and WHEREAS, this property is located between Dike Road and the southwest corner of Courtwright and St. George Roads. The site is accessed from Highway 95 via west on Courtwright Road. The property extends southwest from the conner of Courtwdght and St. George Roads some 3,460 feet to Dike Road. The property is vacant and the terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of several single-family residences. There are no significant drainage patterns, but there are several small washes crossing the south portion of this property from the northeast to the southwest, and WHEREAS, the applicant requests this Area Plan Amendment to allow for residential development of 94 lots ranging in size from 10,000 square feet to 23,000 square feet. The minimum allowable lot size for residential development trader the Residential Recreation (RE) designation is one acre. Bermuda Colony, Bermuda Dunes, and Bermuda Meadows, located east of this project, are classified as Single Family Residential (SFR) by the Mohave Valley South Area Plan. Bermuda Acres and Bermuda Plantation are designated RE by the Area Plan. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the property is presently covered under Mohave Electric Cooperative's franchise for electric and Citizens Utilities Rural Company's franchise for telephone service. The Fort Mojave Tribal Utility Authority provides water m~d sewer service to the area. The site is within the Mohave Valley Fire District, and WHEREAS, a review of FEMA FIRM Panel #040058-2615C indicates the parcel described to be in Zone B, not in the Special Flood Hazard Area, and PAGE 2 OF 2 B.K ~4~ PG ~?a FEE~99045549 RESOLUTION NO. 99-195 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. Approximately 550 notification letters were mailed to individual property owners wfthin a one-mile radius of the subject property. b. The boundary of the site adjoius an existing Single-Family Residential area. c. The proposed use will be consistent with the surrounding land uses. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 12, 1999, the Commission recommended APPROVAL for the Area Plan Amendment subject to the following: 1. The Mohave Valley South Area Plan land use diagrmn will be updated to reflect this change in land use from Residential Recreation (RE) to Single-Family Residential (SFR). 2. The property' will be rezoned to R-O/1 OM. 3. A final plat for North Shore Estates, Tract 4168, ',viii be recorded with Mohave County. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 7, 1999, and posted July 9, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their' special meeting on Monday, July 26, 1999, APPROVED this Area Plan Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
