WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on July 26, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Kathleen A. Tackett-Hicks of Kingman, Arizona, representing the property owners James A. and Pamela Cmnpbell and Michael Lloyd Gallagher of Mohave Valley, Arizona, and WHEREAS, this property is located south of Courtwright Road and west of State Highway 95/Harbor Avenue. The site is accessed from State Highway 95 via west on Courtwright Road to the site, located on the southwest corner of Courtwright Road and St. George Road between Courtwright Road and Dike Road. The property is vacant and relatively flat, sloping slightly to the southwest toward the Colorado River. The surrounding land uses consist of vacant Fort Mohave Indian Reservation land, vacant lots and single-fanaily residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for a portion of Section 15, to be subdivided and known as NORTH SHORE ESTATES, Tract 4168, in Township 17 North, Range 22 West, to be rezoned to R-O/1 OM (Single Family Residential/Mobile Homes Prohibited/Ten Thousand Square Foot Minimum Lot Size). The applicant proposes to divide the 31.64-acre parcel into 94 lots ranging in size fi:om 10,000 square feet to 23, t 01 square feet, along with three homeo;vners' parcels comprising of 6.107 acres. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2615C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan and the Mohave Valley South Area Plan. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave Comnty Planning and Zoning Commission on May 12, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. NORTH SHORE ESTATES, Tract 4168, will be rezoned R-O/10M (Single Faxnily Residential/Mobile Homes Prohibited/Ten Thousand Square Foot Minimum Lot Size). 2. The rezone will be effective upon the recordation of the Final Plat(s) of NORTH SHORE ESTATES, Tract 4168, or for each phase of NORTH SHORE ESTATES, Tract 4168, if the subdivision is phased and the rezone shall not become effective until at least 30 days after final approval of [he change in classification by the Board of Supervisors, as per ARS 11- 829E. 3. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 7, 1999, and posted on July 9, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, July 26, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~ ,.. :~ MOHAVE COUNTY BO~Jt.D OF SUPERVISORS James R.
