HomeMy WebLinkAbout99-200 RESOLUTION NO. 99-200 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF WALNUT CREEK ESTATES, UNIT III, TRACT 3043, BEING A SUBDIVISION OF A PORTION OF SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 7, 1999, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by the owner/developer, Dennis J. Sim, partner of Walnnt Creek Development Company, Kingman, Arizona. The project engineer is C.E. Martin Engineers and Associates, Lake Havasu City, Arizona, and WHEREAS, the property is located approximately four miles southwest of the City of Kingman and is accessed via Interstate 40, then southwest on Oatman Highway (Old Highway 66), then west along McConnico Road to the site, and WHEREAS, the Preliminary Plan depicts 211 acres subdivided into 160 single-family residential lots, with a minimum lot size of one acre, and WHEREAS, the developer has indicated in a letter dated April 1, 1999, that an Extension o£ Time is being requested, as the developer needs time to process and record the Final Plats for the proposed phases in the subdivision, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on July 6, 1992, per BOS Resolution No. 92-236. The first Extension of Time of the conditional approval of the Preliminary Plan for tiffs tract was granted on July 5, 1994, per BOS Resolution No. 94-211. The second extension was granted on September 5, 1995, per BOS Resolution No. 95-370. The third extension was granted on August 5, 1996, per BOS Resolution No. 96-286. The fourth extension was granted on July 7, 1997, per BOS Resolution No. 97-237. The fifth extension was granted on August 10, 1998, per BOS Resolution No. 98-278, with project approval automatically expiring on July 6, 1999. Subdivision Regulations, Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and RESOLUTION NO. 99-200 Page 2 WHEREAS, the Final Plat for Tract 3043-A was recorded on October 6, 1994. Improvements for the first phase of the subdivision were as-built. Since the last Extension of Time for Tract 3043, the developer has submitted a Final Plat for the second phase of the subdivision. The project engineer must submit a corrected Final Plat to address a previous plat review, and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development, including without limitation, roadways and easements including utilities, drainage, etc., will be reviewed by the County and the County Flood Control District and any required changes or modifications will be the responsibility of the developer, and WHEREAS, this action, if approved, will be the sixth Extension of Time for the conditional Preliminary Plan approval of this proposed subdivision, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request does not comply with the Extension of Time Policy due to the following: 1) A phase of this subdivision has not been recorded in the past two years; and 2) the project engineer has not demonstrated in the past year, through the submittal of as-built plans, that any improvements have been completed since the previous extension. c. The developers propose as-building improvements (completing improvements before the Final Plat is recorded), and need an extension if they are to complete and record the second phase of this subdivision. WHEREAS, at the public heaxing before the Mohave County Plamfing and Zoning Commission on May 12, 1999, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution Nos. 92-236, 94-211, 95-370, 96-286, 97-237, and 98-278. 2. Unless significant progress is made in the coming year, including the recordation of a Final Plat for a phase of this tract, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until July 6, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1999, and posted on May 21, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. RESOLUTION NO. 99-200 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 7, 1999, APPROVED this Extension of Time as recommended by the Mohave County Planning m~d Zoning Commission and outlined herein.
