HomeMy WebLinkAbout99-203 RESOLUTION NO. 99-203 A RESOLUTION SETTING FORTH A ZONING USE PEKMIT ON THE N% AND S¼ OF LOT 11, BLOCK ]VI, GOLDEN SAGE RANCHOS, UNIT 83, IN SECTION 13, TOWNSHIP 21 NORTH, RANGE 19 WEST, FOR A DOG KENNEL IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 7, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Charles R. Liverseed and Walter G. and Della L. Roth of Golden Valley, Arizona, and WItEREAS, this property is located south of State Highway 68, between Laguna Road and Teddy Roosevelt Road. The site is accessed from State Highway 68 via south on Teddy Roosevelt Road to Redwall Drive, then west on Redwall Drive to Glen Canyon Road, then north on Glen Canyon Road to the site, located on the east side approximately 700 feet north of Redwall Drive. The south lot has a single- family residence on it along with several accessory buildings. The north lot has a recreational vehicle on it along with several small accessory buildings. The terrain is relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant lots and single-family residences. There are no significant drainage patterns, and WHEREAS, the applicants request this Zoning Use Permit for a dog kemael in an A-R (Agricultural- Residential) zone. In order to have enough property for a kennel, both Mr. Liverseed amd Mr. and Mrs. Roth have applied for the Zoning Use Permit. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. RESOLUTION NO. 99-203 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 12, 1999, the Commission reconunended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a dog kennel in an A-R (Agricultural-Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Pem~it is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1999, and posted on May 21, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 7, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
