A RESOLUTION SETTING FORTH THE APPROVAL OF AN AMENDMENT TO THE MOHAVE
COUNTY GENERAL PLAN, TO AMEND THE LAND USE DESIGNATION OF A PORTION OF
SECTION 26, TOWNSHIP 20 NORTH, RANGE 18 WEST FROM A RURAL DEVELOPMENT
AREA TO AN URBAN DEVELOPMENT AREA, AND AN URBAN DEVELOPMENT AREA/
LIGHT INDUSTRIAL, AS DEPICTED ON EXHIBIT A, AND TO AMEND EXHIBIT VI.8 OF TIlE
GENERAL PLAN TO MATCH, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the special meeting of the Mohave County' Board of Supervisors held on July 26,
1999, a public hearing was conducted to determine whether approval should be granted to amend the
Mohave County General Plan, designating the above-described property as an Urban Development Area,
mad an Urban Development Area/Light Industrial as requested by Roger A. and Linda T. Pencek of
Scottsdale, Arizona, and
WHEREAS, this property is located on both sides of Oatman Road, approximately four and one-half
(4½) miles southwest of the Interstate 40/McConnico Road Intersection, between Yuma Road and
Centemaial Road. The site is accessed from Interstate 40 via west at the McConnico Road exit to Oatman
Road, then southwest on Oatman Road approximately four and one-half (4½) miles to the site, located on
both sides of the road. The majority of the property is on the south side of Oatman Road with a small
portion located on the north side. The property is vacant and the terrain is relatively flat, sloping slightly
to the southwest. The surrounding land uses consist of vacant lots and several scattered single-family
residences. There are no significant drainage patterns, but there are several small washes crossing the south
portion of this property from the northeast to the southwest, and
WHEREAS, the applicant requests this General Plan gnnendment to allow tbr various connnercial,
residential and light industrial services. The Mohave County General Plan designates this area as a Rural
Development Area, and
WHEREAS, the applicant requests this General Plan Amendment change to allow for future
industrial development. The property is presently covered under Citizens Utilities Rural Company' franchise
for electric and telephone service. The site is within the Golden Valley Fire District, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and

WHEREAS, this item was discussed during the Plamfing and Zoning Commission meeting on April
14, 1999, but was continued to the May 12, 1999, Planning mad Zoning Comnfission meeting at the request
of the applicant, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations. Approximately 280
notification letters were mailed to individual property owners within a one-half mile radius
of the subject property.
b. A public meeting was held on March 26, 1999, at the real estate offices of E.R. Bruce,
Golden Valley, where 25 members of the public were present. The commercial proposal
along Oatman Road was acceptable to the public; however, the industrial uses were not well
received.
c. The proposed action and the effect does not comply with the Mohave County General Plan
as follows:
1) Policies 15.1, 15.2, 15.3, relating to the transition from RDA to UDA designations.
2) Policy 21.1, in creating infill commercial development rather than small, individual
strip development projects.
3) Policy 21.6, in locating industrial development with easy access to the various
airports in Mohave County.
4) Policy 37.1, providing lbr economic development in appropriate places in the county.
d. The boundary of the site does not adjoin an existing Urban Development Area and would
create an isolated UDA designated island. The nearest UDA is at least 1 ½ miles distant.
e. The proposed use will not be consistent with the surrounding land uses.
f. The site has legal access.
g. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Areas.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 12, 1999, the Commission recommended APPROVAL for the General Plan Amendment subject to the
following:
1. The SW~/4 of Section 26, excluding the SE¼ SE¼ SW¼, and the WV2 W½ SW¼, in
Township 20 North, Range 18 West will receive an Urban Development AreaJLight
Industrial designation.
2. The E½ NW¼ of Section 26 will receive an Urban Development Area designation.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 7, 1999, and posted July 9, 1999, as required by
Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting
on Monday, July 26, 1999, APPROVED this Amendment as recommended by the Mohave County Platming
and Zoning Commission and outlined herein.
