A RESOLUTION SETTING FORTH A REZONE OF THE WV2 OF SECTION 26, EXCLUDING
TItE SE¼ SE¼ SW¼, THE W¼ NW¼, AND THE WIA W¼ SW¼, IN TOWNSHIP 20 NORTH,
RANGE 18 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE
MINIMUM LOT SIZE) ZONE TO C-2H/SA AND C-2H/25A (GENERAL COMMERCIAL
HIGHWAY FRONTAGE/FIVE ACRE MINIMUM LOT SIZE AND TWENTY-FIVE ACRE
MINIMUM LOT SIZE), R-M (MULTIPLE-RESiDENTIAL), C-MO/36A (COMMERCIAL-
MANUFACTURING/OPEN LOT STORAGE/THIRTY-SIX ACRE MINIMUM LOT SIZE) AND
M/SA (GENERAL MANUFACTURING/FIVE ACRE MINIMUM LOT SIZE) ZONES, 1N THE
MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on July 26,
1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Roger A. m~d Linda T. Pencek of Scottsdale, Arizona, and
WHEREAS, this property is located o~ both sides of Oatmalr Road, approximately four and one-half
(4½) miles southwest of the Interstate 40/McConnico Road intersection, between Yuma Road and
Centennial Road. The site is accessed from Interstate 40 via west at the McConnico Road exit to Oatman
Road, then southwest on Oatn!an Road approximately four and one-half (4½) miles to the site, located on
both sides of the road. The majority of the property is on the south side o£ Oatman Road with a small
portion located on the north side. The property is vacant and the terrain is relatively fiat, sloping slightly
to the southwest. The surrounding land uses consist of vacant lots and several scattered single-family
residences. There are no significant drainage pattems, but there are several small washes crossing the south
portion of this property from the northeast to the southwest, and
WHEREAS, the applicant requests this zone change to allow for various commercial, residential
and light industrial services. The Mohave County General Plan designates this area as an Urban
Developmeut Area and the SW¼ of Section 26, excluding the W½ W½ SW¼ and SE¼ SE¼ SW¼, is
designated Light Industrial, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, this item was scheduled for the Planning and Zoning Commission meeting on April
14, 1999 but was continued at the meeting at the request of the applicant, and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area, and the several small washes crossing the south portion of this property
~¥om the northeast to the south~vest.
WHEREAS, at the public hearing betbre the Mohave County Planning and Zoning Commission on
May 12, 1999, the Commission recommended APPROVAL for a Rezone subject to the fbllowing:
1. Proposed Parcel 1 will be rezoned C-2H/SA (General Commercial Highway Frontage/Five
Acre Minimum Lot Size) and proposed Parcel 2 will be rezoned C-2H/25A (General
Commercial Highway Frontage/Twenty-five Acre Minimum Lot Size); Proposed Parcel 3
will be rezoned R-M (Multiple-Residential); Proposed Parcel 4 will be rezoned C-MO/36A
(Commercial-Manufacturing/Open Lot Storage/Thirty-six Acre Minimum Lot Size); and
Proposed Parcel 5 will be mzoned M/5A (General Manufacturing/Five Acre Minimum Lot
Size) as shown on Exhibit "A".
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The water storage tank in Proposed Parcel 2 will require a Zoning Use Permit.
4. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Upon development Section 27.P (Site Plan Requirements) must be completed
and approved prior to approval of pernfits and before establishing the use.
5. Unencumbered first position roadway right-of-way shall be dedicated to Mohave County in
trust for the public as follows: The dedications shall be along the north boundary of this
property, known as Ash Drive, at a width of 42 feet; along the south boundary, known as
Quartzite Drive, at a width of 42 feet; along the west boundary at a width of 30 feet; along
the east boundary at a width of 35 feet; and along the mid-section line alignment in an
east/west direction (same as Wingate Drive) at a width of 70 feet; and 35 f~et along the north
boundary of the proposed Parcel 4. Twenty-foot radius curves shall be dedicated at all
roadway rights-of-way. An eight-foot Public Utility Easement (PUE) shall be granted
adjacent to all roadway rights-of-way. A title report, to confirm unencumbered first position
rights-ol2way, shall be submitted by the applicant to Mohave County Public Works
Department for this property.

6. lfthe developer creates more than five parcels the applicant must comply with the Mohave
County Subdivision Regulations.
7. The appropriate zm~ing, building, environmental, and floodplain permits will be obtained
prior to construction.
8. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
9. If these conditions are not met within one year this approval will be void. If, at the
expiration of this period, the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statntes Am~otated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 7, 1999, and posted on July 9, 1999, as required by
Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting
on Monday, July 26, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
