HomeMy WebLinkAbout99-215 RESOLUTION NO. 99-215 A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE 60-FOOT ROADWAY EASEMENT KNOWN AS GRANITE DRIVE ADJOINING PARCELS 620 AND 624, STAGECOACH TRAILS, UNIT VH, IN SECTION 7, TOWNSHIP 15 NORTH, RANGE 17 WEST, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 7, 1999, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway easement as requested by Daniel G. and Carrie L. Rynders of Muskego, Wisconsin, and WHEREAS, this easement is located south of Yucca, between Alan~o Road and Interstate 40. The site is accessed from Interstate 40 via the Alamo Road Exit, then south and southeast on Alamo Road approximately 22.2 miles to Rawhide Road, then south approximately four-tenths (0.4) mile on Rawhide Road to Creosote Drive, then west on Creosote Road approximately eleven and one-half miles to Apache Road, then north on Apache Road to Granite Drive, then west on Granite Drive to Doc Holiday Road to the site, located on the west side of Doc Holiday Road. The easement is unimproved and the terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses are vacant with BLM land to the west. There are several washes crossing this property, and WHEREAS, the applicant requests this abandonment to allow for a guest ranch for the disabled. A rezone for this property to establish the guest ranch was granted by the Board of Supervisors on September 8, 1998, via BOS Resolution No. 98-328. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, the Department of Public Works takes no position on the proposed easement abandomnent, and WHEREAS, the Stagecoach Trails Property Owners Association and Brooks Realty have no objection to the proposed easement abandonment, and WHEREAS, Citizens Utilities has no objection to the proposed easement abandonment, and WHEREAS, a review of FEMA FIRM Panel #040058-3000B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and RESOLUTION NO. 99-215 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The roadway easements have been dedicated to the public by the developer (Brooks Realty) but not accepted by the Mohave County Board of Supervisors in behalf of the public. e. There are no significant enviroamental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 12, 1999, the Commission recommended APPROVAL for the Abandomnent subject to the following: 1. Any interest the County may have in the 60-foot roadway easement known as Granite Drive adjoining Parcels 620 and 624 of STAGECOACH TRAILS at Santa Fe Ranch, Unit 7, will be abandoned. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 14, 1999, and May 21, 1999, and posted May 21, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 7, 1999, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
