HomeMy WebLinkAbout99-216 RESOLUTION NO. 99-216 A RESOLUTION SETTING FORTH AN ABANDONMENT OF A 60-FOOT INGRESS/EGRESS AND PUBLIC UTILITY EASEMENT KNOWN AS SILVERADO DRIVE ADJOINING PARCELS 889, 890 AND 891, AND A 60-FOOT INGRESS/EGRESS AND PUBLIC UTILITY EASEMENT ADJOINING PARCELS 890 AND 891, STAGECOACH TRAILS, UNIT IX, IN SECTION 21, TOWNSHIP 16 NORTH, RANGE 16 WEST, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, 1999, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway easement as requested by Gabriel and Linda Ffield of Yucca, Arizona, and WHEREAS, this easement is located south of Yucca, along the west side of Alamo Road and Interstate 40. The site is accessed from Interstate 40 via the Alamo Road Exit, then south and southeast on Alamo Road approximately 16 miles to Silverado Drive, then southwest on Silverado Drive approximately one-half (72) mile to the southeast corner of Parcel 889. The proposed abandonment extends to the southwest corner of Parcel 889. The applicant also proposes to abandon the unnamed easement between Parcels 890 and 891. This easement runs north to south and intersects that portion of Silverado Drive to be abandoned. Silverado Drive has been bladed by Brooks Realty. The north-south easement is unimproved. The terrain is relatively fiat, sloping slightly to the southwest. The surrounding land uses are vacant with widely scattered homesites. There are no significant washes crossing this property, and WHEREAS, the applicants request this abando~nnent to prevent access bet~veen the three properties which they own. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, the Department of Public Works takes no position on the proposed easement abandonment because this roadway easement has not been formerly ~ccepted by the County. Also, the County Attorney's Office believes that there are underlying documents of record which may prohibit this action, and WHEREAS, Brooks Realty does not object to the proposed easement abandounaent, and WHEREAS, the Arizona State Land Commissioner does not object to the abandonment, and WHEREAS, Citizens Utilities Company does not object to the proposed easement abandonment, and RESOLUTION NO. 99-216 Page 2 WHEREAS, a review of FEMA FIRM Panel #040058-2875C indicates the parcel described to be in Zone C, not in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect may not comply with the Mohave County General Plan because it would limit access to State lands for recreation purposes. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 14, 1999, the Commission recommended APPROVAL for the Abandonment subject to the following: 1. Mohave County will extinguish all rights to the ingress and egress easements. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and July 28, 1999, and posted July 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE 1T RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 9, 1999, APPROVED this Abandonment as recommended by the Mohave County Plauning and Zoning Commission and outlined herein.
