HomeMy WebLinkAbout99-217 FEE O.F,C RESOLUTION NO. 99-217 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF NEAL ONE SUBDIVISION, TRACT 3048, BEING A SUBDIVISION OF A PORTION OF THE NE¼ OF SECTION 29, TOWNSHIP 22 NORTH, RANGE 16 WEST, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 7, 1999, a public heating was conducted to determine whether approval should be granted for an Extension of Time as requested by the owner/developer, Mary Brock, Kingman, Arizona. The project engineer is Mohave Engineering Associates, Inc., Kingman, Arizona, and WHEREAS, the property is located approximately one and one-half miles north of the City of Kingman, situated between Thompson Avenue, Jagerson Avenue, Marshall Drive and North Castle Rock Road. The property is accessed via State Route 66, then northwesterly on Thompson Avenue, and WHEREAS, the Preliminary Plan depicts 161.1 acres subdivided into 764 single-family residential lots and six drainage parcels. The residential lots range in size from 6,000 to 8,500 square feet, giving the development an average density of 4.88 dwelling units per acre, and WHEREAS, the developer has indicated in a letter dated April 1, 1999, that an Extension of Time is being requested, as the developer needs more time to process and record the Final Plats for the remaining 17 proposed phases in the subdivision. One phase has been recorded, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on July 5, 1994, per BOS Resolution No. 94-233. The first Extension of Time of the conditional approval of the Preliminary Plan for this tract was granted on October 7, 1996, per BOS Resolution No. 96-357. The second extension was granted on December 1, 1997, per BOS Resolution No. 97-442. The third extension was granted on October 5, 1998, per BOS Resolution No. 98-366, with project approval automatically expiring on July 5, 1999. Subdivision Regulations, Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminate&", and WHEREAS, the Final Plat for Tract 3048-A was recorded on September 21, 1998. Improvements for the first phase of the subdivision were as-built. Since the recordation of the Final Plat for the first phase, the developer has not submitted a Final Plat for the next phase of the subdivision, and RESOLUTION NO. 99-217 rage z WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development, including without limitation, roadways and easements including utilities, drainage, etc., will be reviewed by the County and the County Flood Control District and any required changes or modifications will be the responsibility of the developer, and WHEREAS, this action, if approved, will be the fourth Extension of Time for the conditional Preliminary Plan approval of this proposed subdivision, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request does comply with the Extension of Time Policy due to the following: 1) A phase of this subdivision has been recorded in the past two years; and 2) the project engineer has in the past year demonstrated, through the submittal of as-built plans, the completion of improvements for the first phase of the subdivision. c. The developers propose as-building improvements (completing improvements before the Final Plat is recorded), and need an extension if they are to complete and record the second phase of this subdivision. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 12, 1999, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution Nos. 94-233, 96-357, 97-442, and 98- 366. 2. Unless significant progress is made in the coming year, including the submittal of a Final Plat for the next phase of this tract, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until July 5, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1999, and posted on May 21, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 7, 1999, APPROVED this Extension of Time as recommended by the Mohave County I herein.
