HomeMy WebLinkAbout99-219 RESOLUTION NO. 99-219 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 98-450 SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE SE¼ OF SECTION 14, LYING NORTHWESTERLY OF STATE HIGHWAY 66 (OLD US HIGHWAY 66), IN TOWNSHIP 22 NORTH, RANGE 16 WEST, FOR A GO-KART RACE TRACK IN AN ~ A-R/2A (AGRICULTURAL-RESIDENTI~ TWO ACRE MINIMUM LOT SIZE) AND A fGENERAL~ ZONES, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 7, 1999, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 98-450, setting forth a Zoning Use Permit, should be granted for the above-described property as requested by Mohave County Planning and Zoning Department to correct a scrivener error in the legal description. The property owners of record are Louis and Mary Badertscher of Kingman, Arizona, and WHEREAS, the language to be added has been bolder and double-underlined. Language to be deleted has been struck, and WHEREAS, this property is located west of State Highway 66 (Old US Highway 66) mad north of Kingman Airport. The site is accessed directly from State Highway 66 and the site is located approximately one and one-half (1.5) miles northeast of Mohave Airport Drive, which is the entrance into the Kingman Airport. The property has an one-eighth (l/a) oval asphalt track, an 8-foot by 40-foot storage container, and a gravel parking area on it. Also, there is a driveway with access onto State Highway 66 crossing other property owned by the applicant. The terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant land and several single-family residences to the northeast along State Highway 66. There are no significant drainage patterns, and WHEREAS, the applicants request this Amendment to BOS Resolution No. 98-450, approving a Zoning Use Permit, to correct a scrivener error in the zoning for this property in the legal description. The applicant requests this Zoning Use Permit for a go-kart race track in an A--RAtO~ and A-R/2A (AgriculturaI-Residenfial,~cn Acre and Two Acre Minimum Lot Size) ~ zones. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, the Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2170B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and RESOLUTION NO. 99-219 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 12, 1999, the Commission recomtnended APPROVAL for an Amendment to BOS Resolution No. 98- 450 setting forth a Zoning Use Permit Rezone subject to the following: I. This Zoning Use Permit is for a go-kart race track in an AM~lq3A-end A-R/2A (Agricultural- Residential~q-en--Aere-m~ Two Acre Minimum Lot Size) and A (GeneraB zones as shown on Exhibit "A" and activities related thereto. All the go-karts must be operated with mufflers on their engines. In addition, the hours of operation are as follows: a. Monday thru Thursday No later than 7:00 P.M. b. Friday and Saturday No later than 10:00 P.M. c. Sunday No later than 8:00 P.M. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The applicant will have to apply for an access pemfit from the Arizona Department of Transportation (ADOT) for driveway access onto State Highway 66, through the ADOT permitting process. 4. This location is within the City of Kingman Water Service Area. Any request for water service will require a review by the City of Kingman Municipal Utility Commission (MUCH) and must receive approval from the Kingman Common Council. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 6. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the Board of Supervisors, at their special meeting on Monday, December 21, 1998, APPROVED this Zoning Use Permit as outlined herein and aJnended as follows: 1. The go-kart track shall not operate before 12:00 noon on any day. 2. The decibel level at the property line shall not exceed 65 dBA. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1999, and posted on May 21, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 7, 1999, APPROVED this Amendment to BOS Resolution No. 98-450 setting forth a Zoning Use Permit as recommended by the Mohave County Pla~ing and Zoning Commission and outlined herein.
