RESOLUTION NO. 99-234
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NW¼ NW¼ OF
SECTION 14, EXCLUDING THE EAST 50 FEET AND THE NORTH 42 FEET, IN TOWNSHIP
39 NORTH, RANGE 16 WEST, FOR A WATER TANK IN AN A-R (AGRICULTURAL-
RESIDENTIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9,
1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Joseph L. and Dixie T. Bowler of Mesquite, Nevada, and
WHEREAS, this property is located north of Elbow Canyon Road and east of Mesquite, Nevada.
The site is accessed from Mesquite, Nevada via east on Elbow canyon Road to Zion Park Way, then north
on Zion Park Way to the site, located on the southeast comer of Zion Park Way and Las Vegas Way. The
property is vacant and relatively flat, sloping slightly to the northwest toward the Virgin River. The
surrounding land uses consist of vacant lots and a few scattered single-family residences. There are no
significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Pemfit for a water system facility, including
a water storage tank, well and pumps. The facility will become part of Virgin Mountain Utilities Company's
water distribution system. This facility represents the initial project by Virgin Mountain Utilities Co. which
plans to eventually develop 1,000,000 gallons of water storage capacity to serve upcoming development in
the area. The Mohave County General Plan designates this area as an Urban Development Area and the
Virgin River Communities Area Plan designates this area as Neighborhood Commercial (C- 1), High Density
Residential (12-16 DU/Acre) and Medium Density Residential (5-12 DU/Acre), and
WItEREAS, a review of FEMA FIRM Panel #040058-0200B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan and the
Virgin River Commtmities Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. Virgin Mountain Utilities Co. holds a Certificate of Convenience and Necessity (CC&N).
e. This property is within the Virgin Mountain Utilities Company's franchise area.

f. The site has Iegal access.
g. There are no significant enviromnental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 9, 1999, the Commission reconunended APPROVAL for a Zoning Use Permit subject to the following:
1. This Zoning Use Permit is for a water system facility, including two 50,000-gallon water
storage tanks, well and pumps and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zouing
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use. The tank shall be painted an earth
tone color.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Friday, July 9, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
