L~ MOHAVE COUNTY ~'~" , .~ 07114/1999 04:03P PAGE I OF 2 MOHAVE COUNTY BOARD OF c~ ~'~., RECOROING FEE RESOLUTION NO. 99-235 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A PORTION OF THE NW¼ NW¼ OF SECTION 21, LYING WESTERLY OF LONDON BRIDGE ROAD, IN TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE TO C-MO (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Gale H. Marsh of Lake Havasu City, Arizona, and WHEREAS, this property is located north of Lake Havasu City, west of State Highway 95 and south of Chenoweth Drive. The site is accessed from State Highway 95 via west on Chenoweth Drive to London Bridge Road, then south on London Bridge Road to the site, located on the west side of London Bridge Road approximately 300 feet south of Chenoweth Drive. The property has mini-storage units along with outside storage spaces for vehicles, boats, etc. The property is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of several mini-storages, a boat business, and a fire station to the north. To the south and east are recreational vehicle parks. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on April 7, 1997 via BOS Resolution No. 97-97. This is the applicant's first request for an Extension of Time, and WHEREAS, this Extension of Time will allow the applicant time to complete the site plan and to bring the fence into compliance as stated in the applicant's letter of April 26, 1999, and to complete the other conditions as required by BOS Resolution No. 97-97, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 97-97. Only small (less than 1 foot high) oleander bushes have been planted along London Bridge Road, and WHEREAS, this will be the first and second Extension of Time for this property. This action is to correct a violation of the Mohave County Zoning Regulations, and WHEREAS, a revie~v of FEMA FIRM Panel #040058-3110B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and RESOLUTION NO. 99-235 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Co~mnission on June 9, 1999, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 97-97. 2. This Extension of Time will be in effect until April 7, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
