HomeMy WebLinkAbout99-236 ~OHAVE COUNTY BOARD OF REC:ORDIN~ FEE 0.: ) RESOLUTION NO. 99-236 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE EASTERLY 150 FEET OF THE SOUTHERLY 509.56 FEET OF THAT PORTION OF THE NW¼ SW¼ SW¼ OF SECTION 21, LYING EASTERLY OF LONDON BRIDGE ROAD AND SOUTHERLY OF LAKE DRIVE, EXCLUDING THE NORTHERLY 100 FEET OF THE EASTERLY 100 FEET, IN TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM R-1 (SINGLE FAMILY RESIDENTIAL) ZONE TO C-2 (GENERAL COMMERCIAL) ZONE, IN THE LAKE HAVASU CITY AREA~ MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether an Extension o£ Time for a Rezone should be granted for the above-described property as requested by Romer C. and Cathy Jo Blackmun of Lake Havasu City, Arizona, and WHEREAS, this property is located east of London Bridge Road (Old State Highway 95) and south of Lake Drive. The site is accessed from State Highway 95 via west on Lake Drive to the site, located on the south side of Lake Drive, approximately 100 £eet east of London Bridge Road. The proper~y is vacant and the terrain is relatively flat, sloping to the southwest toward the Colorado River and Lake Havasu. The surrounding land uses consist of general commercial businesses along both sides o£ London Bridge Road to the north, a mobile home park to the east, and vacant property. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Developmant Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on June 1, 1998 via BOS Resolution No. 98-198, and WHEREAS, this Extension of Time will allow the applicant to either develop or sell the property. In a letter dated April 30, 1999, Mr. Blackmun proclaims that "due to unforsean delays, we are, as yet, unable to develop the parcel at this time. We thought it would be sold last year, but that did not work out, therefore we would like a one-year extension, etc.. ", and WHEREAS, the property owner has not accomplished any of the conditions of' approval as required by BOS Resolution No. 98-198, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review o£FEMA FIRM Panel #040058-3110B indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and RESOLUTION NO. 99-236 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. Them are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 98-198. 2. This Extension of Time will be in effect until June 1, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mehave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Extension of Time for a Rezone as reconunended by the Mohave County Plmming and Zoning Conmfission and outlined herein.
