HomeMy WebLinkAbout99-238 OFFICIAL RECORDS OF MOHAVE COUNTY JOA~( I1(: (:ALL, MOHAVE COUNTY RECORDER 07/27/179~ 01:40F' PAGE i OF ~ ItOHAVE COUNTY 80ARO OF SUPERVISORS RECORDING FEE O.OO RESOLUTION NO. 99-238 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT ON THE EAST 590 FEET OF THE WEST 990 FEET OF THE NORTH 220 FEET OF THE SW¼ NE¼ OF SECTION 14, EXCLUDING THE NORTH 35 FEET AND THE EAST 35 FEET, IN TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR AN EQUESTRIAN ACTIVITY ARENA IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, 1N THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit should be granted for the above-described property as requested by Todd R. m~d Joan M. Shumway of Bullhead City, Arizona, and WHEREAS, this property is located east of State Highway 95 between Jerome Avenue and Hulet Avenue. The site is accessed from State Highway 95 via east on Jerome Avenue to Calle del Media, then south on Calle del Media approximately one-quarter mile to an unnamed road, then east on this unnamed road approximately 400 feet to the property, located on the south side of the road. The property has a single- family residence and an equestrian arena on it. The property is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of vacant lots and a few scattered single- family residences. Them are no significant drainage patterns. The Mohave County General Plan designates this area as ma Urban Development Area, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on February 2, 1998 per BOS Resolution No. 98-17, and WHEREAS, the applicant requested in a letter dated April 29, 1999, that the Zoning Use Permit be extended for one year to meet the conditions of the Zoning Use Permit, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 98-17, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2605C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: PAGE 2 OF 2 ~' ?.4,? The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Plmming and Zoning Commission on June 9, 1999, the Con,mission recommended DENIAL for an Extension of Time for a Zoning Use Permit based upon the following: 1. The applicant has not complied with the conditions of BOS Resolution No. 98-17. 2. The objections of the surrounding property owners. 3. The negative impact upon the surrounding neighborhood. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and WHEREAS, at their meeting on July 9, 1999, the Board of Supervisors held a public hearing and considered comments from the public. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Extension of Time for a Zoning Use Permit subjuct to the following conditions: 1. The applicant must comply with the conditions of BOS Resolution No. 98-17. 2. This Extension of Time will be in efl-ect until October 9, 1999. MOHAVE COU~RVISORS Jame
