HomeMy WebLinkAbout99-240 ~ICROFILt~.D ~¥;~,~, ~< OFF'!CIAL RECORDS OF MOHAVE COUNTY JOAN MC CALL~ MOHA~E COUNTY ,E.,~.RPE.~ ~ 07/14/1~ 04:06F' PAGE 1 0~-2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE RESOLUTION NO. 99-240 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT ON THAT PORTION OF PARCEL 266, LYING SOUTHERLY OF STATE HIGHWAY 68, EXCLUDING THE NORTHERLY 300 FEET PARALLEL WITH STATE HIGHWAY 68, IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 19 WEST, FOR A RECREATIONAL VEHICLE PARK IN AN A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit should be granted for the above-described property as requested by Ralph O. Bossert, PE, of ASL Consulting Engineers of Payson, Arizona, representing Max Bevins of Sun Capital, Inc., of Kingman, Arizona, and WHEREAS, this property is located south of State Highway 68 between Emery Park Road and Escuela Road. The site is accessed from State Highway 68 via south on either Emery Park Road or Escuela Road to the site, located approximately 300 feet south of State Highway 68. The property is vacant and relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant land and a realty office to the north and several single-family residences. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on February 2, 1998 per BOS Resolution No. 98-64, and WHEREAS, the applicant requested in a letter dated April 27, 1999, that the Zoning Use Permit be extended for one year. The letter stated that the consulting engineer is working on a development plan and will submit to the Planning and Zoning Department within the next two to three months, and VCItEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 98-64, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area. Note: There are portions of this parcel in Flood Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: RESOLUTION NO, 99-240 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant enviromnental features affecting the site, except the noted Special Flood Hazard Area. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Plaaning and Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for an Extension of Time for a Zoning Use Permit subject to the following: 1. Compliance with the conditions of BOS Resolution No. 98-64. 2. This Extension of Time will be in effect until February 2, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Extension of Time for a Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
