HomeMy WebLinkAbout99-242 o~ ~ ';"-'" OFFICIAL RECORDS OF MOHhVE COUNTY ~%,: JO~N HC CALL~ HOH~VE COUNTY REC:ORDER 07/~4/~999 04:07P PAGE i OF ,~ MOHAVE COUNTY BOARD OF SURERVISORS RECORQIHG FEE 0.00 RESOLUTION NO. 99-242 A RESOLIJTION SETTING FORTH A REZONE OF THE EASTERLY 208.97 FEET OF PARCEL 266 LYING NORTHERLY OF THE CENTERLINE OF STATE HIGHWAY 68, IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/ TEN ACRE MINIMUM LOT SIZE) ZONE TO C-2It (GENERAL COMMERCIAL HIGItWAY FRONTAGE) AND R-I/20M (SINGLE FAMILY RESIDENTIAL/TWENTY THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONES, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Louis F. Desmarais, representing the property owner Lory Ann Reeves of Dolan Springs, Arizona, and WHEREAS, this property is located on the north side of Arizona State Highway 68 between Egar Road and Estrella Road. The site is accessed directly from State Highway 95 to the north at the northwest comer of State Highway 68 and Escuela Road. The property's south boundary is State Highway 68 and the north boundary is Chino Drive. The property is vacant and relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant land and a few scattered single-family residences. Them are no significant drainage patterns, and WHEREAS, the applicant requests this zone change for the purpose of development. The applicant proposes to divide the 5.52-acre parcel into roar', one-half acre parcels zoned R-1/20M (Single Family Residential/Twenty Thousand Square Foot Minimum Lot Size) located in the northern portion along Chino Drive, and the remaining parcel along State Highway 68 to be zoned C-2H (General Commercial Highway Frontage). The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the Mohave County Public Works Department notes that any permitting required by ADOT for accessing State Highway 68 will be the responsibility of the developer, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. RESOLUTION NO. 99-242 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Plmming and Zoning Counnission on June 9, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The southern parcel along State Highway 68 will be rezoned C-2H (General Commercial Highway Frontage) and the four northern parcels will be rezoned R-1/20M (Single Family Residential/Twenty Thousand Square Foot Minimum Lot Size) as shown on Exhibit "A". 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Upon development, the C-2H (General Commercial Highway Frontage) zoned property will require a Section 27.P (Site Plan Requirements) to be completed and approved prior to approval of permits and before establishing the use. 4. That Chino Drive shall be dedicated to the County on behalf of the public as an unencumbered first position right-of-way at a width of 50 feet. Escuela Road shall be dedicated as an unencumbered, first position right-of-way at a width of 30 feet. The remainder of the 50-foot easement known as Escuela Road shall be granted as a 20-foot public utility and drainage easement. Twenty-foot radius curves shall be dedicated at the intersection of Escuela Road and Chino Drive and Escuela Road and State Highway 68. State Highway 68 shall be dedicated to the State of Arizona. As recommended by the County Engineer, a title report demonstrating unencumbered, first position right-of-way shall be submitted for the above rights-of-way. 5. If access is off Escuela Road, Escuela Road must be paved from its intersection of State Highway 68 to the north boundary of the commercial use in accordance with minimum County Standards. If phasing of the proposed commercial use is proposed, then the road paving can be phased as well. 6. The eight feet adjoining Chino Drive shall be granted to the public as a Public Utilities Easement (PUE) and drainage easement. 7. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted by the Board of Supervisors upon Parcel Plat recordation. RESOLUTION NO. 99-242 Page 3 8. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 9. Each parcel shall have legal access. 10. The applicable flood zone(s) shall be noted on the Parcel Plat. 11. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 12. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 13. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public heating to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
