HomeMy WebLinkAbout99-243 ~ ...',;;~, OFF~(:~L RECORI)S OF tlOHAVE (:Ol.]!~!'? ~~~;~ MOHflVE COUNTY [,OARD OF' SUPERVISORS RECORDIN6 FEE RESOLUTION NO. 99-243 A RESOLUTION SETTING FORTH A REZONE OF LOT 17, BLOCK F, GOLDEN SAGE RANCHOS, UNIT 57, IN SECTION 12, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine ~vhether approval should be granted to Rezone the above- described property as requested by Mark Minchey, representing Minchey Construction, Inc., of Escalante, Utah, and WHEREAS, this property is located north of State Highway 68, between Bacobi Road and Tooman Road. The site is accessed from State Highway 68 via north on Bouse Road to the site, located on the southeast comer of Bouse Road and Mazatzal Drive. The property is vacant and relatively flat, sloping slightly to the southwest. The surrounding land uses consist of general commercial businesses to the south along State Highway 68, single-family residences to the north and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change for the purpose to construct a commercial building. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the Mohave County Public Works Department notes that any permitting required by ADOT for accessing State Highway 68 will be the responsibility of the developer, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the fblloxving described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies ~vith the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: PAGE ? OF 2 F;.K 334.~3 PG 725 FEE~gS0428,57 RESOLUTION NO. 99-243 Page 2 1. This property will be rezoned C-2H (General Commercial Highway Frontage). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Prior to development a Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. An additional 10 feet shall be dedicated to the County on behalf of the public as unencumbered first position right-of-way for Bouse Road and Mazatzal Drive, complete with a 20-foot radius curve at their intersection. The right-of-way for Bouse Road must be widened by 10 feet from Highway 68 to the southwest comer of this property. A title report demonstrating unencumbered first position for the right-of-way shall be submitted. The above-mentioned right-of-way shall be dedicated via separate instrument. 4. The access (Bouse Road) shall be paved to minimum County Standards from State Highway 68 around the perimeter of this property onto Mazatzal Drive. If phasing of the commercial project is proposed then the paving can also be phased. 5. The appropriate zoning, building, environmental, and floodplain permits will he obtained prior to construction. 6. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public heaxing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
