RESOLUTION NO. 99-251
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 13, FLANNERY &
ALLEN TRACT 29-27-20, IN SECTION 29, TOWNSHIP 27 NORTH, RANGE 20 WEST, FOR A
DOG KENNEL AND HORSE STABLE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE,
IN THE WHITE HILLS PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9,
1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Daniel and Olivia Hartley of White Hills, Arizona, and
WHEREAS, this property is located east of US Highway 93 and south of White Hills Road, County
Highway Route 145. The site is accessed from US Highway 93 via east-northeast on White Hills Road to
Rocky Point Avenue, then east on Rocky Point Avenue to Wright Road, then south on Wright Road
approximately 350 feet to the site, located on the east side. The property has a single-family residence on
it and an accessory building. The surrounding land uses consist of vacant land and several widely scattered
single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a dog kennel and horse stable in an
A-R (Agricultural-Residential) zone. The Mohave County General Piton designates this area as a Suburban
Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-1600B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 9, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following:

1. This Zoning Use Permit is for a dog kermel and horse stable in an A-R (Agricultural-
Residential) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Friday, July 9, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
