HomeMy WebLinkAbout99-252 INDEXED OFF'ICIAL RE(:ORDS OF MOHAVE JOAN MC CA[.L~ MONAVE COUNTY 07/1~/1999 04:I2P PAGE 1 OE ~IOHAVE COUNTY BOARD OF SUPERV)ZSORS RECORDING EEE -.]0 RESOLUTION NO. 99-252 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE S~ SW¼ NW¼ OF SECTION 22, LYING WESTERLY OF US HIGHWAY 93, IN TOWNSHIP 16 NORTH, RANGE 13 WEST, FOR A PROPANE SALES FACILITY IN A C-MO (COMMERCIAL- MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE WIKIEUP PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at Se regular meeting o£the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Cynthia N. Robertson of Wikieup, Arizona, and WHEREAS, this property is located on the west side of US Highway 93, approximately one-half mile north of Chicken Springs Road, and the site is accessed directly from US Highway 93. The property has a mini-mart, recreational park, and a residence on it and is relatively flat, sloping slightly to the east. The surrounding land uses consist of several other highway businesses, single-family residences, and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a propane sales facility in a C-MO (Con~nercial-Manufacturing/Open Lot Storage) zone. The Mohave County General Plan designates this area as a Rural Development Area and Wikieup is an Outlying Community, and WHEREAS, the Mohave County Public Works Department notes that any permitting required by ADOT for accessing US Highway 93 will be the responsibility of the developer, and WHEREAS, a review of FEMA FIRM Panel #040058-2913B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surromading land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. OF' ~ RESOLUTION NO. 99-252 Page 2 WHEREAS, at the public hearing before the Mohave County Pla~2ng and Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a propane sales facility in a C-MO (Commercial- Manufacturing/Open Lot Storage) zone and activities related thereto as shown on Exhibit 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Cormnission and outlined herein.
