WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Mohave Cellular Limited Partnership, dba Citizens Mohave Cellular, being represented by Bruce A. Mitchell, Right-of-Way Engineer, of Kingman, Arizona, and WHEREAS, this property is located east of Old Trails Interchange on Interstate 40 between Karron Drive and Lorton Road. The site is accessed from Interstate 40 via east at the Old Trails Interchange to Apache Road, then south on Apache Road to Karron Drive, then east on Kan'on Drive to Castle Butte Road, then north on Castle Butte Road approximately 1,000 feet to its temainus and the property on the west side. The property is vacant and rises to the northeast to a small butte. The surrounding land uses consist of vacant land. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a wireless communication facility consisting of a 170-foot tower and support building with related equipment in an A-R (Agricultural- Residential) zone. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2675B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. RESOLUTION NO. 99-253 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a wireless communication facility consisting of a 170-foot tower and support building with related equipment and activities related thereto as shown on Exhibit "A". 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, enviro~m~ental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
