A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NE¼ NW¼ OF SECTION
11, TOWNSHIP 22 NORTH, RANGE 17 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/
36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN
THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9,
1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Everett and Krystal Burge of Kingman, Arizona, and
WHEREAS, this property is located east o£ Stockton Hill Road and north of Cactus Wren Road,
norLh of the City o£ Kingman. The site is accessed from Kingman via north on Stockton Hill Road to the
site, located on the southeast comer of Stockton Hill Road and Brentwood Drive. The property has a single-
family residence on it along with several accessory buildings. The terrain is a large hill rising sharply to the
southwest. The surrounding land uses consist of vacant land and a few widely scattered single-family
residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests ~his Zoning Use Permit to allow a secondary residence in an A-
R/36A (Agricultural-Residential/Thirty-six Acre Minimum Lot Size) zone. The Mohave County General
Plan designates this area as a Suburban Development Area and the Long Mountain Area Plan designates this
area as RR/SA (Rural Residential/Five Acre Minimum Lot Size), and
WHEREAS, the Mohave County Public Works Department requests that the applicant consider
making an unencumbered, first position dedication ~o [he County on behalf of the public of the right-of-way
for Stockton Hill Road where it traverses the northwest comer of this property. Dedication of this right-of-
way will create a small division at the northwest corner of this property. In order to not create this small
division, we request that the applicant consider dedicating this property as a part of the right-of-way. As
recommended by the County Engineer, a Title Report wil! need to be submitted demonstrating
unencumbered first position for this right-of-way, and
WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be
in Zone C, not ~n the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.

c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant envirom~ental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Plmming and Zoning Commission on
June 9, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following:
1. This Zoning Use Permit is for a secondary residence on this property and the activities
related thereto. The floor area of the secondary residence shall comply with the size
requirements in Section 27.R (Accessory or Secondary Residence Requirements). As per
the Mohave County Zoning Regulations, the secondary residence will be used for non-
paying guests and relatives ONLY.
2. The applicant shall comply with ail applicable provisions of the Mohave County Zoning
Regulations, Section 27.R (Accessory' or Secondary Residence Requirements) and a site plan
in accordance with Section 27.R must be completed and approved prior to approval of
permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
1999, APPROVED this Zoning Use Permit as recommended by the Mohave County
Commission and outlined herein.
