HomeMy WebLinkAbout99-257 INDEXEO ..... * .; 04.:14P PAGE flOHAVE (:OUNTY BOARD OF SUF'KRV]ZSORS ' RECORDZNG FEE RESOLUTION NO. 99-257 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 97-320 SETTING FORTH A REZONE OF A PORTION OF THE NW% S¼ SE¼ OF SECTION 22, LYING NORTHEASTERLY OF US HIGHWAY 93, IN TOWNSHIP 24 NORTH, RANGE 19 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/SA (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting o£the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 97-320, setting forth a Rezone, should be granted for the above-described property as requested by Jeffery S. Carlton, RLS, Carlton Sons Nielson Associates, Inc., Surveying of Kingman, Arizona representing The Pet Protection Organization o£ Kingman, Kingman, Arizona, and WHEREAS, the language to be added has been bolded and double-underlined. Language to be deleted has been 3truclc, and WHEREAS, this property is located on the east side of US Highway 93, approximately four and one-quarter (4¼) miles north of Chloride Road, and the site is accessed directly from US Highway 93. The property has a mobile home on it and the terrain is gently rolling hills, generally sloping slightly to the southwest. The surrounding land uses consist of vacant land. There are no significant drainage patterns, and WHEREAS, the applicants request this Amendment to BOS Resolution No. 97-320, approving a Rezone to allow for a no-kill animal shelter to correct the legal description for the property. When The Pet Protection Organization of Kingman rezoned this donated five-acre portion of the 152-acre parcel on the east side of US Highway 93, the legal description was in error on the application. This error was discovered upon review of the required Parcel Plat by the Mohave County Planning and Zoning Department. The only chan-e is to chan~e the NW¼ to S¼ in the legal descrintion, and WHEREAS, the Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-1975B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: RESOLUTION NO. 99-257 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning a_nd Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for an Amendment to BOS Resolution No. 97- 320 setting forth a Rezone subject to the following: 1. The legal description is changed to read "....a Rezone of a portion of the S¼ SEt¼ of Section 22, lying northeasterly of US Highway 93, in Township 24 North, Range 19 West,...." WHEREAS, the notice of hearing was published in The Standard, a newspaper of general cimulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Amendment to BOS Resolution No. 97-320 setting forth a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
