O,¢:' 2 MOHAVE COUNTY P.,OARD OF SNPERViS(hq% REC:OROING FEE %~n RESOLUTION NO. 99-258 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A PORTION OF THE S~ SE¼ OF SECTION 22, LYING NORTHEASTERLY OF US HIGHWAY 93, IN TOWNSHIP 24 NORTH, RANGE 19 WEST, FROM A-R/36A (AGRICULTURAL- RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/SA (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Jeffery S. Carlton, RLS, Carlton Sons Nielson Associates, Inc., Surveying of Kingman, Arizona, representing The Pet Protection Organization of Kingman, Kingman, Arizona, and WHEREAS, this property is located on the east side of US Highway 93, approximately four and one-quarter (4¼) miles north of Chloride Road, and the site is accessed directly from US Highway 93. The property has a mobile home on it and the terrain is gently rolling hills, generally sloping slightly to the southwest. The surrounding land uses consist of vacant land. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on September 2, 1997 via BOS Resolution No. 97-320. BOS Resolution No. 97-320 will be amended to correct the legal description in coinciding BOS Resolution No. 99-257, and WHEREAS, this Extension of Time will allow the applicant time to record the required Parcel Plat and to complete the other conditions as required by BOS Resolution No. 97-320, and WHEREAS, the property owner has accomplished the following conditions of approval as required by BOS Resolution No. 97-320: the Parcel Plat is waiting to be recorded as soon as BOS Resolution No. 97-320 is amended to show the correct legal description, and WHEREAS, this will be the first and second Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-1975B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: PAqE 815 ~$~ !_'! RESOLUTION NO. 99-258 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant enviromnental features affecting the site. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 97-320. 2. This Extension of Time will be in effect until September 2, 1999. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
