L, MOHAVE £:OUNTY RE(URC, E~ 07/14/1999 ~4:1~P PAGE 1 OE MOHAVE COUHTY 80ARD OF SUFER4) RECORDING FEE RESOLUTION NO. 99-262 A RESOLUTION SETTING FORTH A REZONE OF LOTS 21, 22, 23 AND 24, BLOCK 106, NEW KINGMAN ADDITION, UNIT 8, TRACT 1101, IN SECTION 29, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM C-1 (NEIGHBORHOOD COMMERCIAL) ZONE TO R-1 (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 9, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by James L. and Carolyn A. Johnson of Mesquite, Nevada, and WHEREAS, this property is located east of Stockton Hill Road bet~veen Northern Avenue and Jagerson Avenue. The site is accessed fi'om Stockton Hill Road via east on Northern Avenue to North Bank Street, then north on North Bank Street to the site, located on the northeast corner of North Bank Street and Devlin Avenue. The property is vacant and flat, sloping slightly to the southeast. The surrounding land uses consist of vacant lots, single-family residences and several neighborhood commercial businesses to the south. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for building single-family residences. The Mohave County Oeneral Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 9, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: ~,I( R~¢~'i [::',.'~ '?69 FEE:~:971)42876 I~,SOLI.~ION ~O. 99-]~] P~[e 2 1. This property will be rezoned R-1 (Single Family Residential). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Beard of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 23, 1999, and posted on June 24, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Friday, July 9, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
