HomeMy WebLinkAbout99-272 RESOLUTION NO. 99-272 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE S¼ SW¼ SE¼ OF SECTION 17, TOWNSHIP 15 NORTH, RANGE 19 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/ 8A (AGRICULTURAL-RESIDENTIAL/EIGHT ACRE MINIMUM LOT SIZE) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Miles S. Joplin of Miles City, Montana, and WHEREAS, this property is located south of hrterstate 40 and approximately three miles east of State Highway 95. The site is accessed from State Highway 95 via east on Lake Havasu Heights Road (Mohave County Highway 232) to Sky-Viexv Drive, then south on Sky-View Drive to Wagon Wheel Drive, then east on Wagon Wheel Drive to Sky-View Drive, then southeasterly on Sky-View Drive to its terminus where it becomes a 75-foot roadway through Section 18, Bureau of Land Management land, to the southwest coruer of Section 17, then easterly along the section line approximately one-half mile to the southwest comer of the property. The property has a mobile home and the terrain is gently rolling hills sloping slightly toward the northwest. The surrounding land uses consist of vacant parcels. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on June I, 1998 via BOS Resolution No. 98-199, and WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as required by BOS Resolution Nos. 91-50 and 92-77 as requested in his letter dated May 13, 1999, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 98-199, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-3000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: RESOLUTION NO. 99-272 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 14, 1999, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the Ibllowing: 1. Compliance with the conditions of BOS Resolution No. 98-199. 2. This Extension of Time will be in effect until June 1, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 9, 1999, APPROVED this Extension of Time 1hr a Rezone as recommended by the Mohave Planning and Zoning Commission and outlined herein.
