"~'~ RESOLUTION NO. 99-273 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE S¼ SE¼ NE¼ OF SECTION 21, LYING WESTERLY OF STATE HIGHWAY 95, 1N TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM C-RE/36A (COMMERCIAL-RECREATION/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Harrison A. and Joeanne Bumett, Trustees for The Burnett Fmnily Trust, of Parker, Arizona, and WHEREAS, this property is located on the west side of State Highway 95 between Chenoweth Drive and Lake Drive. The site is accessed directly from State Highway 95 to the west and is located approximately one-half nfile south of Chenoweth Drive. The property is vacant and the terrain is rolling hills, sloping generally to the west toward the Colorado River. The surrounding land uses consist of several general commercial businesses, several recreational vehicle parks and single-family residences to the ',vest. There is a drainage ditch along the north side of this property, and WHEREAS, the applicant requests this zone change to allow for mini-storage buildings. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-311 OB indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. RESOLUTION NO. 99-273 Page 2 WHEREAS, at the public hearing before the Mohave County Plamfing and Zoning Commission on July 14, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property' will be rezoned C-2H (General Commercial Highway Frontage). 2. The applicant shall apply for an access permit onto State Highway 95 through the Arizona Department of Transportation (ADOT). In addition, the developer should be aware of the widening of State Highway 95 at this location and should contact ADOT with his site plan to coordinate the possibility of new Right-of-Way through his property. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 4. Lake Havasu City requires that the folloxving design considerations for this project be made so that the entrance into Lake Havasu City can maintain a clean look: a. The building elevations along State Highway 95 should not be metal and should have architectural elements that reflect a quality project. b. The front ten (10) feet of the abutting right-of-way should be landscaped. c. All outdoor storage should be screened from view with attractive walls. d. All identification signs should be wall mounted or of monument design. Pole mounted signs would not be appropriate. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to constraction. 6. The rezone shall not become efi'ective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. if at the expiration of this period the property has not been improved to meet the use fbr which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. RESOLUTION NO. 99-273 Page 3 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, Jul}' 21, 1999, and posted on July 23, 1999, as required by' Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board o£ Supervisors, at their regular meeting on Monday, August 9, 1999, APPROVED this Rezone as recommended by the Mohave County Planning MOHAVE COUNTY BOARD OF SUPERVISORS ~0 ~ James R~bo~air~
