HomeMy WebLinkAbout99-277 .... ~,i~ ,muc ::OUI.~ ':~ '' ?iOHAVE (OJNTY BOARD OF P.E(:OP.B !iq~ FEE RESOLUTION NO. 99-277 A RESOLUTION SETTING FORTH A REZONE OF LOT 3, BLOCK O, GOLDEN VALLEY RANCItOS, UNIT 12, IN THE SE¼ OF SECTION 33, TOWNSHIP 21 NORTH, RANGE 19 'WEST, FROM A-R/2A (AGRICULTURAL-RESIDENTiAL/TWO ACRE MINIMUM LOT SIZE) ZONE TO A-R (AGRICULTUILAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WlIEREAS, at the regalar meeting of the Mohave County Board of Supervisors held on August 9, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Roy E. Yeater, Western Trails Realty of Golden Valley, Arizona, representing Luther A. and Sheryll A. Waldron of Golden Valley, Arizona, and WHEREAS, this property is located south of State Highway 68 between Guthrie Road and Egar Road. The site is accessed from State Highway 68 via south on Egar Road to Tapeats Drive, then west on Tapeats Drive to Dugas Road, then south on Dugas Road approximately 650 feet to the property, located on the west side of Dugas Road. The property is vacant and the terrain is relatively flat, sloping slightly toward the east. The surrounding land uses consist of vacant parcels and a few widely scattered single- family residences. There are no significant drainage patterns, and WltEREAS, the applicant requests this zone change to allow for development of one-acm homcsites. The applicant proposes m divide the 2.35-gross-acre parcel imo two 1-net-acre parcels. The Mohave Couuty General Plan designates this area as Suburban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2300B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. WHEREAS, the following described Findings of Fact are for the above-captioned item: a. AIl notices have been advertised and posted according to regulations. b. The proposed action and efl'cct complies with the Mohave County General Plan and the Sacramento Valley/Golden Valley Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding lm~d uses and temtin. d. The neighboring area contains land uses similar to the above-proposed action. e. The site has legal access. There are no significant environmental features affecting the site. RESOLUTION NO. 99-277 Page 2 g. This property is within the franchise area of the Golden Valley hnprovemem District and is in compliance with Policy and Procedure Memorandum 97-3 (Minor Land Divisions). WHEREAS, at the public hearing bcibre the Mohave Comity Plamfing and Zoning Commission on July 14, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-R (Agricultural-Residential/One Acm Minimum Lot Size). 2. Thc submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted by the Board of Supervisors upon Parcel Plat recordation. 4. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 5. Each parcel shall have legal access. 6. The applicable flood zone(s) shall be noted on the Parcel Plat. 7. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The rezone shall not become elt'ective until at least 30 days after final Board of Supervisors approval lbr the change in classification, as per ARS 11-829E. 9. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave Comity Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine complim~ce with the schedule for development, or cause the property to revert to its fbrmer zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
