RESOLUTION NO. 99-279
A RESOLUTION SETTING FORTH A REZONE OF PARCEL 13, EXCEPT THE WEST 660 FEET
OF TIlE SOUTH 660 FEET, GOLDROAD STATION, UNIT 1, IN THE SW¼ OF SECTION 22,
TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/
TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A AND A-R/10A (AGRICULTURAL-
RESIDENTIAL/FIVE ACRE AND TEN ACRE MINIMUM LOT SIZE) ZONES, IN THE GOLDEN
VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9,
1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Roy E. Yeater, Western Trails Realty of Golden Valley, Arizona,
representing Norma R. Murdoch el'Golden Valley, Arizona, and
WHEREAS, this property is located south of State Highway 68 between Estrella Road and Egar
Road. '['he site is accessed fi'om State ltighxvay 68 via south on Egar Road to the property, located on the
east sidc of Egar Road approximately 1,290 fleet south of Diabase Drive. The property is vacant and the
terrain is relatively fiat, sloping slightly toward the southeast. The surrounding land uses consist of vacant
parcels and a few widely scattered single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for development. The applicant
proposes to divide the 27.48-gross-acre parcel imo two approximately 5-net-acre parcels and one 17.42-net-
acre parcel. The Mohave County General Plan designates this area as an Urban Development Area, and
WHEILEAS, a review of FEMA FIRM Panel #040058-2300B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the lbllowing described Findings of Fact are tbr the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and e~'l'ect complies with the Mohave County General Plan, and the
Sacramento Valley/Golden Valley Area Plan.
c. The site is adequate fbr the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains land uses similar to the above-proposed action.
c. The site has legal access.
There are no siguificant environmental features affecting the site.

WHEREAS, at the public hearing belbre the Mohave County Plamfing and Zo~fing Commission on
July 14, 1999, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The two southern proposed parcels will be rezoned A-R/5A (Agricultural-Residential/Five
Acre Mininmm Lot Size), and the northern proposed parcel will remain zoned A-R/10A
(Agricultural-Residential/Ten Acre Minimum Lot Size).
2. The submittal and recordation ora Parcel Plat prepm'ed in accordance with Article 3.16 of
the Mohave County Subdivision Regulations emd 102.04-B of the Standard Specifications
and Details is required.
3. The eight feet adjoining to all rights-of-way shall be granted to the public as a Public
Utilities Easement (PUE) and drainage easement.
4. All public easements granted on the Parcel Plat will be accepted by the Board of Supervisors
upon Parcel Plat recordation~
5. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
6. Each parcel shall have legal access.
7. The applicable flood zoue(s) shall be noted on the Parcel Plat.
8. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
9. The rezone shall not become effective until at least 30 days afler final Board of Supervisors
approval fbr the change in classification, as per ARS 11-829E.
10. If the required parccl phtt prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulatioas and 102.04-B el! the Standard Specifications and Details is not
recorded within one year of Bom'd of Supervisors approval, this rezone approval will be void.
All other conditions are to be met upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to
the owner and applicaat who requested the rezoning) shall schedule a public hearing to grant
an extension, determine compliance with the schedule for development, or cause the property
to revert to its fbrmer zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW TItEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday Aagust 9, 1999, APt)ROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
