HomeMy WebLinkAbout99-280 RESOLUTION NO. 99-280 A RESOLUTION SETTING FORTH A REZONE OF THE NE¼ OF LOT I, PARADISE ACRES, UNIT 1, IN TItE NE'¼ NE¼ OF SECTION 14, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/2A (AGRICULTUIL~L-RESII)ENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE TO A-R (AGRICULTUI~&L-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meedng of the Mohave County Board of Supervisors held on August 9, 1999, a public bearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Terry Lee Ishmael of Kingman, Arizona, and WHEREAS, this property is located south of State Highway 68 between Aztec Road and Bacobi Road. The site is accessed fi'om Slate Highway 68 via south on Bacobi Road to the property, located on the southwest corner of Shipp Drive and Bacobi Road. The property has a single-family residence on it and the terrain is relatively flat, sloping slightly toward the southwest. The surrounding land uses consist of vacant parcels and a few widely scattered sing[e-fanrily residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for development. The applicant proposes to divide the 2.07-gross-acre parcel into two approximately I-net-acre parcels. The Mohave County General Plan designates this area as an Urban Development Area, and WI IEREAS, a review of FEMA FiRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, siuce Shipp [)rive and Bacobi Road are section line roads, the Mohave County Public Works Department requests that the applicant consider dedicating an additional two feet of roadway right-of- way. If the applicant dedicates this additional two feet it will reduce each lot size to less than one acre and it will not meet the A-R (Agricultural-Residential/One Acre Minimum Lot Size) zoning requirements, and WHEREAS, the lhllowing described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. Thc proposed action and effect complies with the Mohave County General Plan and the Sacramento Valley/Golden Valley Area Plan. c. The site is adequate For the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains [and uses similar to the above-proposed action. RESOLUTION NO. 99-280 Page 2 e. The site has legal access. There are no significant environmental features affecting the site. g. This property is served by the Valley Pioneers Water Company and is in compliance with Policy und Procedure Mcmoraudum 97-3 (Minor Land Divisions). WHEREAS, at the public hearing betbre the Mohave County Planning and Zoning Conunission on July 14, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These pamels will be rezoned A-R (Agricultural-Residential/One Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of thc Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is reqnired. 3. Thut a 20-fbot radins cnrve shall be dedicated as road right-of-way to Mohave County on behalf of the public, at the intersection of Bacobi Road and Shipp Drive. 4. The eight feet ac[joining to all rights-of-way shall be granted to the public as a Public Utilities Easement (PUE) and drainage easement. 5. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted by the Bnard ol' Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The applicable flood zone(s) shall be noted on the Parcel Plat. 9. The appropriate zoning, building, enviromnental, and floodplain permits ~vill be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall uot become effective until at least 30 days after final Board of Supervisors approval Ibr the change in classification, as per ARS 11-829E. 11. lfthe required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Befbre the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule tbr development, or cause the property to revert to its l~nner zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. RESOLUTION NO. 99-281} Page 3 WHEREAS, the uotice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, flint the Bom'd of Supervisors, at their regular meeting on Monday, August 9, 1999, APPROV ED this Rezone as recommended by the Mohave County Planning Commission and outlined herein.
