HomeMy WebLinkAbout99-282 RESOLUTION NO. 99-282 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE SOUTHERLY 430 FEET OF TItE EASTERLY 300 FEET OF PARCEL 240, STOCKTON HILL RANCHES, UNIT 8, IN THE NW~A OF SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM A-IUIOA (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO C-RE (COMMERCIAL-RECREATION) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, ] 999. a public hearing was conducted to determine whether an Extension of Time tbr a Rezone should be granted for the above-described property as requested by Gezina and Fehkje Schippers of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road and between Jane Avenue and Jeffi'ey Avenue. The site is accessed from Stockton Hill Road via east on Jane Avenue to Parker Street, then north on Parker Street to Evelyn Avenue, then west on Evelyn Avenue to the site, located on the northeast comer of Mountain View Drive and Evelyn Avenue. The property has a single-family residence and several accessory buildings on it. The terrain is rolling hills rising to the northwest and generally sloping to the southeast. The surrounding land uses consist of vacant lots and a few scattered single-family residences. There are no significant drainage patterns. The Mohave Coanty General Plan designates this area as a Suburban Development Area and the Long Mountain Area Plan designates this RR/5A (Rural Residential/Five Acre Minimum Lot Size), and WHEKEAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on June 1, 1998 via BOS Resolution No. 98-216, and WHEREAS, this Extension of Time w'ill allow the applicant to complete her project ibr a small bed and breakfast facility along with astronomy activities and tours of northern Arizona, for seven people or less, using a rbur-whccl drive vehicle on approximately three acres and to meet the other conditions as required by [~t)S l{esolution No. 98-216. and WtlEREAS, the property owner has not accomplished any of the conditions of approval as required by BGS Resolution No. 98-216, and WHEREAS, this will be the first Extension of Time for this property, and RESOLUTION NO. 99-282 Page 2 WI IEREAS, a review of FEIVIA I?iRM Panel #040058-2155B indicates the parcel described to be in Zone C, not in thc FEMA Special Flood Hazard Area. and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the eflkct complies with the Mohave Count}' General Plan and the Long blountain Area Plan. c. Thc site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There arc no significant enviromnenta[ features affecting the site. This reqoest complies with the Extension of Time Policy. WHEREAS, at the pubhc heat nlg belbre the Mohave County Plamaing and Zoning Commission on July 14, 1999, the Commission recommended APPROVAL fbr m~ Extension of Time for a Rezone subject to the following: l. Compliance with the conditions of BOS Resolution No. 98-216. 2. This Extension of Time will be in efl'ect nntil June 1, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona Jul5 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and the Mohax e County Zomng Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on 1Vlonda,~., August 9, 1999, APPI~OVED this Extension of Time for a Rezone as recommended by the Mohavc County Planning and Zoning Commission and outlined herein.
