HomeMy WebLinkAbout99-283 OB/ti/~.999 04:13F' PA6k ! !'!OHAVE COUNTY BOARD OF RESOLUTION NO. 99-283 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF PARCEL 1-11, MOUNTAIN VISTA RANCIIES, PHASE 1,1N SECTION 1, TOgVNSHIP 24 NORTH, RANGE 15 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL~THIRTY-SlX ACRE MINIMUM LOT SIZE) ZONE TO A-R/12A AND A-RJSA (AGRICULTURAL-RESIDENTIAL/TWELVE ACRE AND FIVE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHAVE COUNTY GENERAL AREA, MOIIAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, ] 999. a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for thc above-described property as requested by Charles Montana of Phillips Ranch, California, and WHEREAS, this property is located north of US Highway 66 and east of Antares Road. The site is accessed ii-om US Highway 66 via north on Antares Road to Tres Drive, then east on Tres Drive to Jctmings Road. then north approximately one-quarter mile to the property, located on the northeast corner of Jcnnings Road and Troutman Drive. The property is vacant mid the terrain is flat, sloping slightly to the northeast. The surrounding land uses consist of vacant lots. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on October 7, 1996 via BOS Resolution No. 96-352. There have not beeu any requests for Extensions of Time, and WHEREAS, this Extension of Time will allow Mr. Charles Montana, the trustee for Mr. John Montana, to complete the conditions as required by BOS Resolution No. 96-352 and as noted in his letter dated Muy 27, 1999, and WI 115REAS, the property owner has not accomplished any of the conditions of approval as required by Bt)S l<esolution No. 96-352, aud WIIEREAS, this Wrill be the lirst, second aud third Extensions of Time for this property, and B, IIEREAS, a review of FEMA FIRM l auel #040058-2025B indicates the parcel described to be in Zone C, not in thc FEMA Special Flood Hazard Area, and RI.SOLU 1 ION NO. 99-283 Page 2 WItEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adeqnate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. 'lhe site has legal access. f. There are no significant environmental features affecting the site. This request complies with the Extension of Time Policy. WHEREAS, at the public hcaring belbre the Mohave County Plmming and Zoning Commission on July 14, 1999, the Commission recommended APPROVAL lbr an Extension of Time for a Rezone subject to thc lbllowing: 1. Compliance with the conditions of BOS Resolution No. 96-352. 2. This Extension of Time will be in effect until October 7, 2000. 3. This will be the last Extension of Time unless significant progress is made to complete the conditious of BOS Resolution No. 96-352. WHEREAS, the notice ot' hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and the Mohuve County Zoning Regulations. NOW TIIEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 9, 1999, AP t)I~.OVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
