HomeMy WebLinkAbout99-284 RESOLUTION NO. 99-284 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF PARCEL 1-14, MOUNTAIN VISTA RANCHES, PHASE 1, IN SECTION 1, TOWNSHIP 24 NORTH, RANGE 15 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/7A AND A-R/5A (AGRICULTURAL-RESIDENTIAL/SEVEN ACRE AND FIVE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WI IEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, 1999, a public hearing was condttcted LO determine whether an Extension of Time tYr a Rezone should be graoted lbr thc above-described property as reqaested by David A. Montana of Los Angeles, California, and WlIEREAS, this property is located north oFUS Highway 66 and east of~Mltares Road. The site is accessed l¥om US Highway 66 via north on Antares Road to the property, located north of Tres Drive on the east ;nad west side of Antares Road. The property is split by Antares Road with 19.40 acres on the west side and 18.25 acres on the east side. The property is vacant and the terrain is flat, sloping slightly to the northeast. The sarrounding land uses consist of vacant lots. Them am no significant drainage patterns. The Mohavc County General Plan designates this area as a Rural Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on October 7, 1996 via BOS Resolution No. 96-353. There have not been any requests for Extensions of Time, and WHEREAS, this Extension of Time will allow the applicant to co~nplete the conditions as required by BOS Resolution No. 96-353 and as requested in his letter dated May 26, 1999, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 96-353. and WIIEIIlSAS, this will be thc lit'st, second and third Extensions of Time for this property, and WHEREAS, a review of F I~MA FIICM Panel #040058-2025B indicates the parcel described to be in Zone C, not ill the FEMA Special Flood Hazard Area, and WHEREAS, the fbllowing described Findings of Fact are for the above-captioned item: RESOLU FION NO. 99-284 Page 2 a. All helices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WIIEREAS, at the public hcz~riag belbre the Mohave County Planning and Zoning Commission on .luly 14, 1999. the Commission rectmnnended APPROVAL lbr an Extension of Time for a Rezone subject to thc fullowing: 1. Compliance with thc conditions of BOS Resolution No. 96-353. 2. This Extension of'lime will be in effect until October 7, 2000. 3. This will be the last Extension of Time unless significant progress is made to complete the conditions of BOS Resolution No. 96-353. WIIEREAS, tine notice o1' hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave Coanty, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFOILE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, Angust 9, 1999, AI'PROVISD this Extension of Time for a Rezone as recmrLmended by the Mohave County Planning and Zoning Commission and outlined herein.
