HomeMy WebLinkAbout99-285 RESOLUTION NO. 99-285 A RESOLUTION SETTING FORTH A REZONE OF LOT 17 AND LOT 32, GATEWAY ACRES, TPo~.CT 8, IN THE NE¼ OF SECTION 13, TOWNSHIP 25 NORTH, RANGE 20 WEST, FROM A- R/5A (AG RICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE TO A-R/2A (AGRICULTUILAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, IN THE MOItAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Byron ti. Nelson, representing Jerron Partners, a General Partnership, ok'Las Vegas, Nevada, and WHEREAS, this properly is located east of US Highway 93 and northwesterly of Pierce Ferry Road, betweea Fifth Street and Seventh Street. The site is accessed fi'om US Highway 93 via east on Seventh Street to Amana Road, then south oa Amana Road approximately 660 feet to the site, located on the west side of Amana Road. The property is vacant and the terrain is relatively flat, sloping slightly toward the sonthwest. The surrounding land uses consist of vacant parcels. There are no significant drainage pattems, and WItEREAS, thc applicant requests this zone change to allow for residential development. The applicant proposes to divide the I O-gross-acre parcels into lbur approximately 2½-gross-acre parcels. The Mohave Coanty General Plan designates this area as a Rural Developmem Area, which specifies a minimum parcel size of five acres, and WHEREAS, a review of FEMA FiRM Panel//040058-1775B indicates the parcel described to be in Zone C~ not in the FEMA Special Flood Itazard Area, and WItEREAS, the lbllowing described Findings of Fact are for the above-captioned item: a. Afl notices have been adx.ertised and posted according to regulations. b. The proposed action und el'feet DOES NOT COMPLY with the Mobave County General Plan. c. The site is adequate lk)r the action intended and the use is consistent with the surrounding land uses and terrain. cl. The neighboring area contains land uses similar to the above-proposed action. Them are other lot splits to this size that were done befbre the implementation of the General Plan. RESOLUTION NO. 99~285 Page 2 e. The site has legal access. There are no significaat environmental features affecting the site. WHEREAS, at the public hearing belbre the Mohave County Plamfing and Zoning Commission on July 14, 1999, the Commission recommended DENIAL Ibr a Rezone based upon the following: I. The proposed minimum parcel size of two and one-half (2~A) gross acres is one-half (V2) of the minimum parcel size of 5 acres as specified in the Mohave County General Plan for designated Rural Dex.elol~mcnt Areas. 2. The Mohave Coanty Pablic Works Department recommends denial because the existing infi'astructure does not have the capacity to support the proposed increase in density. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingmtm, Mohave County, Arizona, July 21, 1999, ~d posted on July 23, 1999, as req~red by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEI~FORE BE IT RESOLVED, that the Bo~d of Supe~Ssors, at their regul~ meeting on Monday, August 9, 1999, DENIED this Rezone as recommended by the Mohave County Plying ~d Zoning Commission and outlined hcl'cin.
