A RESOLUTION SETTING FORTH A REZONE OF THE NE¼ SE¼ OF SECTION 3, TOWS'qSHIP
20 NORTH, I~NGE 14 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX
ACRE MINIMUM LOT SIZE) ZONE TO A-R/SA AND A-R/12A {AGRICULTURAL-
RESIDENTIAL/FIVE ACRE AND TWELVE ACRE MINIMUM LOT SIZE) ZONES, IN THE
MOHAVE COUNTY GENERAL Al,tEA, MOHAVE COUNTY, ARIZONA.
Wit El'tEAS, at the regnlar 1netting of the Mohave County Board of Supervisors held on August 9,
1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Dari Carlton of CS NA Surveying of Kingman, Arizona, representing
Maria M. Merida of Reseda, Calilbrnia, and
WIlEREAS, this property is located north of Mohave County Highway 193 (Old US Highway 93)
between Vista Verde Lane mrd Gila Monster Road. The site is accessed from US Highway 93 via west-
northwest on Mohave County Highway 193 (Old US Highway 93) approximately five and two-tenths (5.2)
miles to Gila Monster Road. then north un Gila Monster Road approximately 495 feet to the southeast comer
of thc property. The property is vacant and the terrain is gently rolling hills, generally sloping to the east.
The surrounding hind uses consist ut' vacam parcels and a few widely scattered single-family residences.
Theft: are no signii~cant drainage pult~ms, and
WIIEREAS, the applicant requests this zone change to allow' for development. The applicant
proposes to divide the 39.22-gross-acre parcel into four 5-net-acre parcels and one 16-net-acre parcel. The
Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WIIEREAS, thc following described Findings of Fact are for the above-captioned item:
a. All notices have beea advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. Thc site is adeqnate l~r the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains land uses similar to the above-proposed action.
e. The site has legal access.
There are no significant environmental features affecting the site.

Vv'HEREAS, at the public hearing before the Mohave County Plmming and Zoning Commission on
July 14, 1999, the Commission recommeuded APPROVAL for a Rezone subject to the fbllowing:
l. The Ibm' western proposed parcels will be rezoned A-R/5A (Agricultural-Residential/Five
Acre Minimum Lot Size) aud the eastern proposed parcel will be rezoned A-R/12A
(Agricultural-Residential/Txvelve Acre Minimum Lot Size) as shown on Exhibit "A." No
more tban five parcels will be created.
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
thc Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. That a 30qbot road right-of-way lmown as Vista Verde Lane along the west boundary, a 35-
ibot road right-of-way known as Tiger Tale Drive along the north boundary, and a 42-foot
road right-of-way knowl~ as Gila Monster Road along the east boundary shall be dedicated
to Mohave Couuty on behalf of the public and accepted by the Mohave County Board of
Supervisors. [n addition, 20-foot radius curves are required at all dedicated roadway
intersection points.
4. ri'he eight feet adjoining to all rights-of-way shall be granted to the public as a Public
Utilities t~asement (PUE) and drainage easement.
5. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted
by the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The applicable flood zone(s) shall be noted on the Parcel Plat.
9. ]'be appropriatc zoning, building, environmental, and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.
[ 1. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not
recorded within one year of Board of Supelwisors approval, this rezone approval will be void.
All other conditions are to be met upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to

the owner and applicant xvho requested the rezoning) shall schedule a public hearing to grant
an extension, determine compliance ~vith the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance ~vith Arizona
Revised Statates Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice ol' hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County. Arizona, July 21, 1999, and posted on July 23, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, Augost 9, 1999, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
