A ZONING USE PERMIT ON PARCEL 3C-2, AS SHOWN ON PAP, CEL PLATS BOOK 12, I'AGE 7, IN THE SE'A SECTION 14, TOWNSHIP 20 NORTH, RANGE 18 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/SA (AGRICULTURAL- RESll)ENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 9, 1999, a public hearing was conducted Lo determine whether a Zoning Use Permit should be granted for the above-described property as requested by William E. and Dorothy L. Yarnell of Kingman, Arizona, and Wl lEREAS, this property is located northwest of Oatman Road (Old US Highway 66) and north ,,)l' AqLtarius Drive. The site is accessed from Interstate 40 via west at the Interstate 40/McConnico Interchange to Oatman Road (Old US Highway 66), then southwest on Oatman Road to Aquarius Road, then ,,','est on Aquarius Road to the site, located on the northwest corner of Aqnarius Road and Yuma Road. The property is vacant and relatively fiat. sloping slightly to the southwest. The surrounding land uses consist of vacant land and several single-family residences. There is a real estate office at the corner of Aquarius Road and Oatman Road. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in am A- R/5A (Agricultural-Residential/Five Acre Minimm'n Lot Size) zone for Mrs. Yarnell's mother. The Mohave County General Plan designates this area as a Rural Development Area, and Wit El{Ir, AS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C. not in the FEMA Special Flood ltazard Area, and WItEREAS, the tbllowing described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate tbr the action intended and the use is consistent with the surrounding hind uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant enviromnental features affecting the site. RESOLUTION NO. 99-287 Page 2 WII EREAS, at the public hearing belbre the Mohave County Plamfing and Zoning Commission on July 14. 1999, tbe Commission recommended APPROVAL for a Zoning Use Permit subject to the f~lloxx lng: I. This Zoning Use l~ermi[ is lbr a secondary residence on this property and the activities related thereto. The lloor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). As per the Mohave County Zoning Regulations, the secondary residence will be used for non- paying guests and relatives ONLY. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan ia accordance witlt Section 27.R must be completed and approved prior to approval of permits and bcIbre establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use bas not commenced within one year of Board approval of the Zoning Use Permit or if thc usc has been discontinued for six months, then approval shall terminate at that date. 5. '['his Zoning Use Pcrlnit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Mouday, August 9, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Phmning and Zoning Commissiou and outlined herein.
