HomeMy WebLinkAbout99-289 RESOLUTION NO. 99-289 A RESOLUTION SETTING FOP, I'H Ah' EXTENSION OF TIME FOR A ZONING USE PERMIT ON A PORTION OF THE S½ SE'A OF SECTION 22, LYING NORTHEASTERLY OF US HIGHWAY 93, IN TOWNSHIP 24 NORTH, RANGE 19 WEST, FOR A NO-KILL ANIMAL SHELTEP,, CLINIC, THRIFT STORE, TEACHING AP, EA AND PETTING ZOO IN AN A-R/SA (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN TItE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WItEREAS~ at the regniar meeting of the Mohave County Board of Supervisors held on August 9, 1999. a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit should be granted f~)r thc above-described propcrty as reqnested by Diana Moll of the Pet Protection Orguniz;~tion of Kingman, Arizona, and WItEREAS, this property is located on the east side of US Highway 93, approximately four and one-quarter (4'/~) riffles north of Chloride Road, and the site is accessed directly from US Highway 93. The property has a mobile home on it and the terrain is gently rolling hills, generally sloping slightly to the southwest, l'he surrounding land uses consist of vacant land. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on September 2. 1997 via BOS Resolution No. 97-321. BOS Resolution No. 97-321 will be amended to correct the legal description in a coinciding BOS Resolution (Resolution No. 99-288), and WIIEREAS, this Extension of Time will allow the applicant time to record the required Parcel Plat and to complete the other conditions as required by BOS Resolution No. 97-320. BOS Resolution No. 97- 321 c:.mnot become e~l'ective until aL[I thc conditions of the accompanying rezone action on this property are met. and WI IEREAS, the property owner has accomplished the following conditions of approval as required by BOS Kesolution No. 97-320: the Purccl Plat is waiting to be recorded as soon as BOS Resolution No. 97-320 is ;maended to show tine correct legal description, and WIIEREAS, this will be the first and second Extension of Time for this property, and WHEREAS, a review ofFEMA F1RM Panel #040058-1975B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and RESOLUTION NO. 99-289 Page 2 WHEREAS, the Ibllowing described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action und ettbct complies with the Mohave County General Plan. c. The site is adequate tbr the action intended and the use is consistent with the surrounding land uses and terrain. cl. The site has legal access. e. There are no significant environmental features affecting the site. This request complies with the Extension of Time Policy. W11EREAS, at the pablic hearing beIbre the Mohave County Plalming and Zoning Commission on July 14~ 199% thc Commission recommended APPROVAL tbr an Extension of Time for a Zoning Use Permit sa(ject to the ~bllowing: 1. Compliance with the conditions of BOS Resolution No. 97-321. 2. This Extension of Time will be in effect until September 2, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizoua Revised Statutes and the Mohave County Zoning Regulations. NOW TIIEREFORE lIE IT P, ESOLVED. that the Board of Supervisors, at their regular meeting on Monday.
