HomeMy WebLinkAbout99-291 RESOLUTION NO. 99-291 A RI~SOLUT1ON SETTING FORTH A ZONING USE PE1LMIT ON THE E~ OF GOVERNMENT LOT 3, IN SECTION 1, TOWNSltlP 21 NORTH, ILa, NGE 17 WEST, FOR A SECONDARY RESIDENCE 1N AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave Cotmty Board of Supervisors held on August 9, 1999, a pablic hearing was condocted lo determine wq~ether a Zoning Use Permit should be granted for the above-described property as requested by Gary R. and Joann Pope of Kingmm~, Arizona, and WI IEREAS, this property is located west of Stockton Hill Road and north of the west extension of Gordon Drive. The site is accessed ii'om Stockton Hill Road via west on Gordon Drive to Ridgecrest Drive, then northwest and west on Ridgccrest Drive to North Harvard Street, then north on North Harvard Street to the property, located on the west side at the tem~inus of Shadow Mountain Drive and its intersection with North Harvard Street. The property has a single-fanfily residence on the eastern portion of the lot and the tcrrain is relatively flat, sloping to the southeast. The terrain rises to the northwest toward the mountains. Thc surrounding land uses consist of vacant land and single-family residences. There are numerous small lot subdivisions to the east in the City of Kingmmr. There are no significant drainage patterns, and Vv'l IEREAS, thc applicant requests this Zoning Use Permit to allow a secondary residence in an A-R (Agricultural-Residential) zone lbr Mr. Pope's mother. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review of FEMA FIICM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the ~bllowing described Findings of Fact are for the above-captioned item: All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. RESOLUTION NO. 99-291 Page 2 WI I EREAS, at the public hearing beibre the Mohave Coumy Plamfing and Zoning Commission on July 14, 1999, the Commission reconnnended APPROVAL ibr a Zoning Use Permit subject to the tbllowing: 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondmw residence shall comply with ~e size requirements ~n Section 27.R (Accessory or Secondary Residence Requirements). As per the Mohave County Zoning Regulations, the secondary residence will be used for non- puying guests and relalives ONLY. 2. Thc applicant shall comply with all applicable provisions of the Mohave Co~ty Zoning Regulations. Section 27.R (Accessory or Secondm3~ Residence Requirements) and a site pl~ in accordance with Section 27.R must be completed and approved prior to approval of permits and bel~re establishing the use. 3. The appropriate zoning, building, enviromnental, m~d floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one ye~ of Bo~d approval of the Zoning Use Permit or if thc ase has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is snbject to revocation upon 60 days notification by the Bo~d of Snpervisors iL in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 21, 1999, and posted on July 23, 1999, as required by Arizona Revised Statutes and thc Mohave County Zoning Regulations. NOW THEREFORE B E IT RESOLVED, that the Board of Supemisors, at their reg~ar meeting on Monday, August 9, 1999. AI'PROV lED this Zoning Use Permit as recommended by the Mohave CounW Plmming and Zoning Commission and outlined herein.
