HomeMy WebLinkAbout99-318 4, ~ ~ ],~ RECOI:iDB I10HflVE C 0 I~!~ Y 09/'09/~999 O:L:2SP PAGE J OF ~IOHAVE BOUN~'f BOAR{) OF RECORDING FEE RESOLUTION NO. 99-318 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NW¼ SW¼ AND THE S~ SW¼ NW¼ AND THE W¼ SW¼ SE¼ NW¼ AND THE W~ E~ SW¼ SE¼ NW¼ OF SECTION 17, TOWNSHIP 40 NORTH, RANGE 15 WEST, FOR A RECREATIONAL VEHICLE PARK IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Rulan S. and Shamma L. Lee of Littlefield, Arizona, and WHEREAS, this property is located south of Interstate 15 and County Highway 91 (Old US Highway 91), southwest of the Interstate 15/County Highway 91 Interchange. The site is accessed from Interstate 15 via south at the Cotmty Highway 91 exit, then south and southwest on County Highway 91 approximately one and one-half miles to a 40-foot unnamed access road on the southeast side of County Highway 91, this unnamed road meandering to the southeast, then southwest approximately one (1) mile to the northwest comer of this property. The property has a gun club and farm on it. The terrain is gently rolling hills, generally sloping to the southeast toward the Virgin River. The surrounding land uses consist of vacant land and a few widely scattered single-family residences. There is Bureau of Land Management (BLM) land to the south, east and west of this location. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a Recreational Vehicle Park in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as a Suburban Development Area. The Virgin River Conununities Area Plan designates this area as a Suburban Development Area and this area is considered a "Green Belt Recreation Area" with no other land use designation, and WHEREAS, a review of FEMA FIRM Panel #040058-0200B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, this item was scheduled for the Planning and Zoning Commission meeting on July 14, 1999 but was continued due to a lack of a quorum of Planning and Zoning Commissioners, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. RESOLUTION NO. 99-318 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. Them are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a Recreational Vehicle Park in an A-R (Agricultural- Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zolxing Regulations. Section 27.J (Recreational Vehicle Park Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The existing 40-foot access road to this site is a Bureau of Land Management (BLM) Right- of-Way Grant A-18809; Mohave County records indicate that it is effective for a period of 30 years. This Right-of-Way shall be assigned to Mohave County on behalf of the public as a perpetual easement. The Mohave County Public Works Department recommends that an additional 10 feet be assigned to Mohave County on behalf of the public for a total of a 50-foot wide right-of-way. Tiffs Zoning Use Permit will not become effective until the right- of-way is granted by the BLM. 4. There will not be any development allowed within the Virgin River floodway. 5. The access road shall be constructed to Mohave County standard Specification 161, Unpaved Surface Base Course using native materials, and Standard Detail 60, 50-foot Right-of~Way with two 12-foot wide Travel Lanes, as per Board of Supervisors Resolution No. 91-335 from County Highway 91 to the Recreational Vehicle site. 6. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 7. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 8. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. RESOLUTION NO. 99-318 Page 3 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and posted on August 20, 1999, as required by 3a-izona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
