HomeMy WebLinkAbout99-319 RESOLUTION NO. 99-319 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 98-197 WHICH APPROVED THE REZONE FOR A PORTION OF THE W~ NW¼ NW¼ NW¼ OF SECTION 33, TOWNSHIP 41 NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public hearing was conducted to determine whether approval should be granted for the Rescission of the resolution for the Rezone for the above-described property as requested by the Mohave County Planning and Zoning Department. The property owners of record are James O. and Charlotte Spears of Beaver Dam, Arizona, and WHEREAS, this property is located west of Connty Highway 91 and south of Biasi Ranch Road. The site is accessed from County Highway 91 via west on Biasi Ranch Road approximately four-tenths (0.4) mile to the property, located on the south side in the northwest corner of Section 33. The property has a single-fanfily residence on it and the terrain is relatively flat, sloping to the southwest. The surrom~ding land uses consist of single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a rezone to R-1 (Single Family Residential) by the Mohave County Board of Supervisors on June l, 1998, via BOS Resolution No. 98-197. It has not been extended and the property owners have expressed a desire not to complete the rezone action. A letter has been sent to the owner notifying them that the approval of their rezoning has expired and an Extension of Time was required. There were no responses to the Planning and Zoning Department's inquiry concerning an Extension of Time. Another letter was sent informing the property owners that it would be scheduled for rescission. The Mohave County General Plan designates this area as an Urban Development Area. The Virgin River Communities Area Plan designates this area as Low Density Residential (LDR), and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan and the Virgin River Communities Area Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. RESOLUTION NO. 99-319 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended that BOS Resolution No. 98-197 be RESCINDED and that the zoning will revert to A-R (Agricultural-Residential). WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and posted on August 20, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1999, RESCINDED BOS Resolution No. 98-197 and REVERTED the zoning to A-R (Agricultural-Residential), as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
