RESOLUTION NO. 99-321
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF FAIRWAY VILLAGE, TRACT 4154, BEING A
SUBDIVISION OF GOVERNMENT LOT 2, AND A PORTION OF GOVERNMENT LOT 1,
SECTION 3, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY
AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
7, 1999, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by the owner/developer and project engineer, Glen Ludwig of Ludwig Engineering
Inc., San Bernardino, California, and
WHEREAS, the property is located approximately four miles south of Bullhead City. The property
is accessed via State Highway 95, inunediately south of Lipan Boulevard and west one-tenth of a mile to
the site, and
WHEREAS, the Preliminary Plan depicts 70 acres subdivided into 357 single-family residential lots,
and one common parcel containing 3.20 acres. The minimum residential lot size is 4,800 square feet. The
average residential lot size is 5,715 square feet, and
WHEREAS, the owner/developer has indicated in a letter dated July 6, 1999, that an Extension of
Time is being requested so that the developer can continue to wait for the California economy to improve,
spurring the market for improved-lot sales in the South Mohave Valley, at which time the developer intends
to process the Final Plats for this subdivision. The developer indicates in his request that Final Plats and
improvement plans have been prepared for some phases of this proposed subdivision, and that gmat expense
has been incurred by the developer in their preparation. The developer contends that such work warrants
continued extension of the conditional approval for this subdivision; however, the developer has not
submitted any Final Plats to Mohave County for actual review, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on October 2, 1995, per BOS Resolution No. 95-404. The first Extension of Time for the
approval of the Preliminary Plan was grm~ted on January 5, 1998, per BOS Resolution No. 98-3. The second
extension was granted on October 5, 1998, per BOS Resolution No. 98-343, expiring automatically on
October 2, 1999. Subdivision Regulation, Article 3.10-1 states: "Upon application to the Commission and
prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the
Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then
all proceedings relating to the plat shall be terminated.", and

WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development, without limitation, roadways and easements including
utilities, drainage, etc., will be reviewed, and has reconm~ended that any required changes or modifications
will be the responsibility of the developer, and
WHEREAS, staff recommended denial of this request, as the developer has not submitted a Final
Plat for any phase of this subdivision, and since the last extension has not submitted any documentation to
demonstrate the completion of any improvements for the tract, and as last year's extension included a
provision that without such progress, staff' would recommend denial of any further extensions, and
WHEREAS, this action, if approved, will be the third Extension of Time for the conditional
Preliminary Plan approval of this proposed subdivision, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request does not comply with the Extension of Time Policy in that the policy states,
"Normally, a maximum of a one (1) year extension will be granted for 'adverse economic
conditions'." This is the third extension based on such a request.
c. The Preliminary Plan Extension of Time Policy also states, "If there has been no activity on
the subdivision for three (3) years, the Planning amd Zoning Department will recommend
denial of the Extension of Time." The developer has not made a plat submittal for review
since October, 1995. The only file activity since that time has been the annual Extension of
Time request by the developer.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Conm~ission on
August 11, 1999, the Commission reconunended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution Nos. 95-404, 98-3 and 98-343.
2. Unless siguificant progress (including the submittal and recordation of a Final Plat for the
first phase of this subdivision) is made in the coming year, this will be the last Extension of
Time for the Preliminary Plan approval of Fairway Village, Tract 4154.
3. This Extension of Time will be in effect until October 2, 2000.
VfHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 18, 1999, and posted on August 20, 1999, as
required by Arizona Revised Statutes and the Mohave County Zo~fing Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 7, 1999, APPROVED this Extension of Time as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
