HomeMy WebLinkAbout99-323 OFF'?:IAL F:E(:ORDS OF !'!OHAVE lOAN MC (:AL{., ,~'fOHAVE COUN'¥Y 09/09/1999 01:26P PAgE ~OHAVE COUNTY ~,OARO qF RECOROIN6 FEE ), RESOLUTION NO. 99-323 A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE NORTHERN 191.45 FEET OF PUERTO VERDE CIRCLE ADJOINING LOTS 8, 9, 10 AND 11, BLOCK 2, OF PALM ESTATES H, TRACT 4104-A, AND LOT 1 OF RIO HACIENDA, TRACT 1224, IN THE SE¼ OF SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway right-of-way as requested by Donald and Deborah Rathbone of Fort Mohave, Arizona, and WHEREAS, this roadway is located east of State Highway 95 and north of Camp Mohave Road. The site is accessed from Camp Mohave Road via north on Puerto Verde Circle to Vista Del Oro. The proposed abandonment extends from this intersection northward to the terminus of Puerto Verde Circle. The roadway has been cleared but is not improved. The terrain is flat. Residential development has occurred on all sides of the roadway, with a concrete block wall running along the west and north sides of the right-of-way There are no significant washes crossing this property, and WHEREAS, the applicant proposes to abandon this portion of Puerto Verde Circle to increase his property size and extend an existing fence line. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the Department of Public Works does not object to the abandonment provided the entire portion of Puerto Verde Circle, north of Vista Del Oro, is abandoned to create an "L" intersection. Leaving a small stub of publicly owned property could be a collection point for weeds and debris which could be a maintenance problem for the County, and WHEREAS, Citizens Water Resources, Fort Mojave Tribal Utility Authority, Mohave Electric Cooperative and the Fort Mojave Mesa Fire Department have no objection to the proposed roadway abandonment, and WHEREAS, a review of FEMA FIRM Panel #040058-2435D indicates the parcel described to be in Zone AO-2 foot, in the Special Flood Hazard Area, and RESOLUTION NO. 99-323 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The County has no current or anticipated need for the property for the purposes originally intended when the property was acquired. c. Lots 8, 9, 10 and 11, Block 2, of PALM ESTATES II, Tract 4104-A, are being assessed "by site;" hence, the County will not benefit from increased tax revenue if these lots expand. d. Lot 1 of RIO HACIENDA, Tract 1224, is being assessed per square foot. The abandonment would increase the lot's area by approximately 5,750 square feet. The land's assessed valuation is projected to increase from $13,722 to approximately $15,500. e. This portion of Puerto Verde Road does not appear to be regularly maintained by the County. f. The public benefit appears to be commensurate with the value of the property to be abandoned. g. The proposed action and the effect complies with the Mohave County General Plan. h. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. i. The site has legal access. j. There are no significant environmental features affecting the site, except the above mentioned flood hazard zone. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended APPROVAL for the Abandonment subject to the following: 1. The entire right-of-way for Puerto Verde Circle north of Vista Del Oro shall be abandoned per Exhibit "A." 2. Lot 1, RIO HACIENDA, Tract 1224, and the adjoining Lots 8, 9, 10 and 11, Block 2, of PALM ESTATES II, Tract 4104-A, will accrue those abandoned portions of Puerto Verde Circle, as shown on Exhibit "B," increasing their acreage rather than creating separate parcels (ARS §28-7205). 3. Written concurrence shall be submitted from Citizens Communications prior to roadway abandonment. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and August 25, 1999, and posted August 20, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. RESOLUTION NO. 99-323 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at fl~eir regular meeting on Tuesday, September 7, 1999, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
