A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE S½ OF PARCEL 210-E
AS SHOWN ON PARCEL PLATS BOOK 2, PAGE 41, THE S¼ NW¼ SW¼ NW¼ SE¼ OF
SECTION 2, IN TOWNSHIP 21 NORTH, RANGE 18 WEST, FOR A CHILD CARE GROUP
HOME IN AN A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE)
ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
7, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Michael W. and Jennifer A. Willis of Golden Valley, Arizona,
and
WHEREAS, this property is located north of State Highway 68, between Aztec Road and Bacobi
Road. The site is accessed from State Highway 68 via north on Hope Road to the site, located on the east
side of Hope Road approximately 350 feet north of Earl Drive. The property has a single-family residence
on it and the terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist
of vacant lots and a few' scattered single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a child care group home in an A-R/
10A (Agricultural-Residential/Ten Acre Minimum Lot Size) non-conforming zone. The Mohave County
General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2150B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, this item was originally scheduled for the Plmming and Zoning Commission meeting
for December 9, 1998 but was continued by the Planning Staff to allow for the Mohave County Zoning
Regulations to be amended to reflect guidance from the State of Arizona regarding Child Care Group
Homes, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.

e. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 11, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a child care group home in an A-R/10A (Agricultural-
Residential/Ten Acre Minimum Lot Size) zone and activities related thereto. The nun~ber
of children is limited to no greater than 10 children for compensation in accordance with
Mohave County Zoning Ordinance, Section 27.T, Ctfild Care Facilities in Residential Zones
Requirements.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements)
must be completed and approved prior to approval of permits and before establishing the use.
3. The applicant shall comply with all applicable provisions of the Arizona Department of
Economic Security (DES), Child Care Administration, Article 52: Certification and
Supervision of Family Child Care Home Providers.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
6. qq~is Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 18, 1999, and posted on August 20, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
