HomeMy WebLinkAbout99-336 RESOLUTION NO. 99-336 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 90-173 WHICH APPROVED THE REZONE FOR LOT 2, BLOCK N, GOLDEN SAGE RANCHOS, UNIT 85, IN SECTION 23, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public heating was conducted to determine whether approval should be granted for the Rescission of the Resolution for the Rezone for the above-described property as requested by the Mohave County Planning mad Zoning Department. The property owner of record is Joe D. Bryan of Las Vegas, Nevada, and WHEREAS, this property is located south of Arizona State Highway 68, between Laguna Road and Estrella Road. The site is accessed from Arizona State Highway 68 via south on Estrella Road to Diabase Drive, then east on Diabase Drive to Cove Road, then south on Cove Road to the site, located on the west side approximately 350 feet south of Diab~/se Drive. The property is vacant and relatively flat, sloping slightly to the southeast. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a rezone to A-R/lA (Agricultural- Residential/One Acre Minimum Lot Size) by the Mohave County Board of Supervisors on July 2, 1990, via BOS Resolution No. 90-173. There have not been any requests for Extensions of Time from the property owner. A letter has been sent to the owner notifying them that the approval of their rezoning has expired and an Extension of Time was required. There were no responses to the Planning and Zoning Department's inquiry concerning an Extension of Time. Another letter was sent infornfing the property owner that it would be scheduled for rescission. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended that BOS Resolution No. 90-173 be RESCINDED and that the zoning will revert to A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size).
