MOHAVE COON!T MOHAVE BOUNTY BOARD n~' RECORDING FEE B~00 RESOLUTION NO. 99-339 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF PARCEL A AND B AS SHOWN ON RECORD OF SURVEY BOOK 8, PAGE 19, A PORTION OF PARCEL 503, STOCKTON HILL RANCHES, UNIT 10, IN SECTION 29, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Nancy Stahr of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road between Calle Sonoita and Calle Charcas. The site is accessed from Stockton Hill Road via east on Jane Avenue to Chemm Road, then north on Cherum Road to Calle Sonoita, then east on Calle Sonoita to Avenida Del Burro, then north on Avenida Del Burro to the site, located on the southeast comer of Avenida Del Burro and Calle Bomoa. The property is vacant. The terrain is gently rolling hills, sloping slightly toward the southeast. The surrounding land uses consist of vacant parcels and scattered single-family residences. There are no significant drainage patterns on the property. The Mohave County General Plan designates this area as a Suburbm~ Development Area and the Long Mountain Ama Plan designates this area as RR/5A (Rural Residential/Five Acre Minimum Lot Size), and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on August 4, 1997 via BOS Resolution No. 97-278. It has not been extended, and WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as required by BOS Resolution No. 97-278, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 97-278, and WHEREAS, this will be the first and second Extensions of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and RESOLUTION NO. 99-339 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan and the Long Mountain Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 97-278. 2. This Extension of Time will be in effect until August 3, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and posted on August 20, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1999, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
