HomeMy WebLinkAbout99-340 '~hDEXED 99m"~6~7 BK 33?0 Pti 702 OF'F[C[~L RECORDS OF HOH~VE (rJJF~TY JO~N HC (:~LL~ HOH~VE DOuN-rY RECORDER 10/13/1999 01:08P PAGE i (]f:' 2 MOHAVE COUNTY BOARD OF SUF'ERVISORS RECOROIN6 FEE RESOLUTION NO. 99-340 A RESOLUTION SETTING FORTH A REZONE OF PORTIONS OF LOTS 64 AND 65, MEADVIEW ESTATES, IN SECTION 15, TOWNSHIP 30 NORTH, RANGE 17 WEST, FROM R-E (RESIDENTIAL-RECREATION) ZONE TO C-RE (COMMERCIAL-RECREATION) ZONE, IN THE MEADVIEW PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Richard A. Wuelly, Trustee of the A. & R. Family Real Estate Trust #2, of Henderson, Nevada, and WHEREAS, this property is located west of Pierce Ferry Road approximately one and one-half (1 ½) miles southwest of Meadview Boulevard. The site is accessed from Pierce Ferry Road via west, then southwest and then south on Newport Drive to Caribbean Drive, then west on Caribbean Drive to Starlight Way, then south on Starlight Way to Captain's Cove, then east on Captain's Cove to the site, located on the south side approximately 300 feet east of Starlight Way. The property is vacant and is on the top of rolling hills, generally sloping to the southeast. The sun'ounding land uses consist of vacant Bureau of Land Management (BLM) land on the west and south. There are vacant, privately-owned lots to the north and east, along with a few widely scattered single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to C-RE (Commercial-Recreation) to allow for a Bed and Breakfast style resort home. The Mohave County General Plan designates this area as a Rural Development Area and the Meadview Area is considered an Outlying Community, and WItEREAS, a review of FEMA FIRM Panel #040058-1275B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. PAGE 2 OF 2 BE S~?O PG ?0~ FEE~991)6~.!g'7 RESOLUTION NO. 99-340 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C-RE (Commercial-Recreation). 2. The access road shall be constructed to Mohave County Standard Specification 161, Unpaved Surface Base Course using native materials, and Standard Detail 60, a 50-foot Right-of-Way with two 12-foot wide Travel Lanes, as per Board of Supervisors Resolution No. 91-335 from Pierce Ferry Road to the site. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 4. All structures shall be of earth-tone colors. 5. Power lines serving the site will be installed within one year. 6. The appropriate zoning, building, environmental, and floodplain pemfits will be obtained prior to construction. 7. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted on September 17, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting 4, 1999, APPROVED this Rezone as recommended by the Mohave County Planning  ~VE~ ~BOARD OF SUPERVISORS -"~ - Bnste~.
